The use of this contingency contract cost increase is subject to approval requirements established by the County Procurement Officer. |

SUMMARY:
Approval of the Contract with Composite Apps, Inc. for Disease Control and Preventative Health Technology Enabled Solution will allow the Health Care Agency to efficiently provide uninterrupted continuity of services to support County's disease mitigation efforts, to achieve the requirements in the Epidemiology and Laboratory Capacity Enhancing Detection Expansion Grant and, optimize public health services to individuals living in Orange County.
BACKGROUND INFORMATION:
The California Department of Public Health has provided a funding opportunity for the County of Orange through the funds available from Centers for Disease Control and Prevention (CDC) for implementation of strategies that support the Epidemiology and Laboratory Capacity (ELC) Enhancing Detection Expansion initiative. The funding via this award mechanism is provided to support the following objectives:
· Assure that provisions are in place to meet future surge capacity needs including point of care or other rapid result testing for local outbreaks.
· Establish a modernized public health laboratory, epidemiological surveillance and other workforce capacity.
· Support necessary expenses to implement and oversee expanded testing capacity for COVID-19/SARS-CoV-2, including the ability to process, manage, analyze, use and report the increased data produced.
· Establish a robust SARS-CoV-2 program that ensures adequate testing is made available according to CDC priorities, including but not limited to: diagnostic tests, tests for contact tracing, containment and mitigation and surveillance of asymptomatic persons to determine community spread.
· Coordinate and engage with partners to build and enhance capacity for infection prevention.
On March 23, 2021, your Honorable Board of Supervisors (Board) approved the acceptance of the ELC Expansion grant award in the amount of $115,488,386. The grant performance period is January 15, 2021, to July 31, 2024.
The services described in this contract are existing services entered under Resolution of the Board of Supervisors of Orange County, California Authorizing Emergency Contracting Authority dated April 21, 2020. The Board Resolution, pursuant to Government Code Section 25502.7, allowed the Board to direct the County Procurement Officer (CPO) or designee, to engage independent contractors to perform services related to the COVID-19 Emergency for the County or County officers, with or without the furnishing of material, to the extent that the CPO determined that an immediate, emergency need exists due to imminent threat to life, health, property or essential public service for a services contract due to the COVID-19 Emergency. No further sole source justification was required for a contract or amendment to be entered into at that time.
Composite Apps, Inc.
The Health Care Agency (HCA) initiated a contract with Composite Apps, Inc. on November 25, 2020, under the Emergency Contracting Authority for the CuraPatient, Software-as-a-Service (SaaS) platform that helps individuals and providers engage in a patient’s care experience before, during and after a vaccination. Features include enabling patients to find and self-schedule for services, automated appointment reminders to individuals and allowing a caregiver and/or family to manage the care of their household including children and older adults. A critical aspect of the platform was to ensure the scale and precision of vaccine management and operations to efficiently provide public health services to a population size of 3.2 million in Orange County in an accelerated manner within a compressed timeline during the pandemic. The platform features that support clinic operations and administrative tasks include schedule and resource management, obtaining patient consent, signing clinical notes and securely reporting required data directly into the California Immunization Registry (CAIR). The platform has expanded and continues to support access to new COVID-19 vaccine products such as pediatric vaccines and a variety of recommended booster doses including the new bivalent booster recently released in September 2022. The features provided by Composite Apps, Inc. via their platform, have also supported effective access to vaccine services in accordance with CDC guidelines in response to the current Monkeypox outbreak in Orange County community.
This Contract will allow HCA to continue with the existing platform to provide uninterrupted communicable disease interventions against viruses like COVID-19, Flu and Monkeypox and eliminate manual, paper-based processes, which results in more reliable and effective care activities. The scope of work of this Contract also includes professional services to help implement the necessary configurations to the platform to enable a swift and effective response to any emerging communicable disease threats where pharmaceutical or testing interventions may be warranted to ensure the safety of our community.
Outcomes
The full-feature platform for COVID-19 testing, vaccination, community engagement and consult-to-treatment services has over 1.3 million Orange County subscribers and over 3,000 providers who will have the ability to continue to interact with this service provision within Orange County.
The platform drove volume and efficiencies when needed, reducing wait-time and maximizing limited inventory through prioritization and virtual queues:
The platform allowed the field service teams to get closest to the vulnerable community to address vaccine hesitancy and aided collaboration with local community organizations to host or promote clinics in the neighborhoods among the hard-to-reach populations and in areas with low vaccination rates. The platform also virtually coordinated homebound and transportation service requests.
The proposed contract is a Sole Source contract and a Sole Source Justification form is attached to this Agenda Staff Report, see Attachment C. Composite Apps, Inc. developed the CuraPatient Apps currently in use by HCA and are the only vendor capable of providing the upgrade, support and maintenance services. No other vendor has access or permissions to manage the source code of the application.
This Contract does not currently include subcontractors or pass through to other providers. See Attachment B for Contract Summary Form. The Orange County Preference Policy is not applicable to this Sole Source contract award.
The Contractor's performance has been confirmed as at least satisfactory. HCA has verified there are no concerns that must be addressed with respect to Contractor's ownership/name, litigation status or conflicts with County interests.
HCA requests that the Board authorize the County Procurement Officer or Deputized designee to execute the Contract with Composite Apps, Inc. as referenced in the Recommended Actions.
FINANCIAL IMPACT:
Appropriations for this Contract are included in Budget Control 042 FY 2022-23 Budget and will be included in the budgeting process for future years.
This Contract will be 100 percent Federally funded through July 31, 2024, by the Epidemiology and Laboratory Capacity Coronavirus Response and Relief grant. HCA will re-evaluate funding and absorb costs after July 31, 2024, based on funding available at that time.
The proposed Contract includes provisions allowing HCA to terminate the Contract, reduce the level of services, and/or renegotiate the levels of services provided, as necessary. This includes a notice that allows HCA adequate time to transition or terminate services to clients, if necessary.
