RECOMMENDED ACTION(S):

 

 

1.

Find that the project is categorically exempt from CEQA, Class 1 (Existing Facilities) pursuant to CEQA Guidelines Section 15301.

 

2.

Authorize the County Procurement Officer or Deputized designee to execute a contract with Parking Concepts, Inc. for Management & Operation of Multi-Facility Parking Complexes, effective upon execution of all necessary signatures for a term of three years from that date, in an amount not to exceed $13,500,000, with the option to renew for one additional two-year term.

 

 

 

 

SUMMARY:

 

Approval of a contract for Management & Operation of Multi-Facility Parking Complexes will provide for continued maintenance and operation of parking facilities in the Santa Ana Civic Center, the Manchester Complex and the Westminster Civic Center and will provide efficient parking operations services to benefit County of Orange employees and the public.

 

 

 

BACKGROUND INFORMATION:

 

OC Public Works is responsible for the maintenance and operation of parking facilities within the Santa Ana Civic Center (Civic Center), Manchester Complex (Manchester) and the Westminster Civic Center (Westminster). The parking facilities include both public and employee parking lots and structures. The Civic Center area parking facilities were established as a joint project between the County of Orange (County) and the City of Santa Ana under the terms of a Development Agreement between the parties governing financial, operational and maintenance activities in the Civic Center. The Manchester facilities are located adjacent to the Lamoreaux Justice Center in the City of Orange. The Westminster facilities are located in the Westminster Civic Center in the City of Westminster.

 

The current contract for Management & Operation of Multi-Facility Parking Complexes (Services) with Parking Concepts, Inc. (Contractor) was approved by the Board of Supervisors (Board) on October 31, 2017, and subsequent one-year renewals were approved on October 6, 2020, and October 19, 2021, respectively, and expire on November 30, 2022. In order to continue Services, a new contract is necessary.

 

On June 2, 2022, OC Public Works issued a Request for Proposals (RFP) for Services. The RFP was advertised on the County online bidding system. Two proposals were received and were deemed responsive. On August 16, 2022, the evaluation panel completed the evaluation process and provided its recommendations. Based on the criteria set forth in the RFP, OC Public Works is recommending a contract for Services be awarded to the Contractor for Services. A summary of the rankings is attached as part of the Memorandum of Recommendation (Attachment C).

 

OC Public Works is procuring these Services in accordance with the 2021 Contract Policy Manual Section 3.3-102.

 

The Orange County Preference Policy (OCPP) was applicable and incorporated into this solicitation; however, no OCPP qualified proposals were submitted.

The Contractor is responsible for the day-to-day operation of the facilities, including fee collection and daily depositing of revenue into County accounts in accordance with County revenue collection procedures and general facility maintenance. In addition, the Contractor monitors for adherence to parking policies and procedures established for each facility. Contractor costs are based on the number of pre-approved hours worked by Contractor’s staff at rates authorized in the contract. Costs may vary slightly from year to year depending upon operating hours and other unique facility demands established by the County.

 

OC Public Works is recommending Board approval of Contract MA-080-22011621 (Contract) with the Contractor for Services, effective upon execution of all necessary signatures for a term of three years from that date, in an amount not to exceed $13.5 million, with the option to renew for one additional two-year term. The Contract amount allows for monthly variations in the Contractor’s staffing, which are adjusted as the need for additional coverage arises, as in the case of building startups like the County Administration South and North, or other special events that may require extra staffing throughout the high-traffic Santa Ana Civic Center. Similar staffing adjustments are made at all other County parking facilities depending on usage.

 

OC Public Works has conducted due diligence on the Contractor. Reference checks were satisfactory and completed with the City of Pasadena, Ontario International Airport and City of Beverly Hills regarding similar Services.

 

This Contract includes subcontractors. See Attachment B for the Contract Summary Form. 

 

Compliance with CEQA: The proposed project is Categorically Exempt from CEQA, pursuant to CEQA Guidelines Section 15301 (Class 1) of the CEQA Guidelines, because it is an approval of a contract for management and maintenance of existing County facilities, with negligible or no expansion of existing issues.

 

 

 

FINANCIAL IMPACT:

 

Appropriations and revenue are included in the FY 2022-23 Budget for Fund 137, Parking Facilities, and Fund 828, Civic Center Parking Authority, and will be included in the budgeting process for future years.

 

The proposed Contract includes a provision stating the County has the right to immediately terminate the Contract for cause or after 30 days’ written notice without cause without penalty to the County.
