Authorize the Director of OC Waste &
Recycling or designee to execute the contract with SWT Engineering, Inc. for
Olinda Final Closure Design & Permitting, effective upon Board of
Supervisors approval or upon execution of all necessary signatures, whichever
occurs later, and shall continue for 48 months from the issuance of the
Notice to Proceed, in an amount not to exceed the cumulative contract total
of $811,802. Authorize the Director of OC Waste &
Recycling or designee to make ministerial or non-material changes to the
contract. |
SUMMARY:
Approval of the
contract with SWT Engineering, Inc. for Olinda Final Closure Design &
Permitting will support the planning for County landfill system operations and
maintain compliance with state and federal regulations.
BACKGROUND
INFORMATION:
OC Waste & Recycling (OCWR) is
responsible for managing the solid waste disposal system for the County of
Orange (County), including North Region Landfills that consist of the active
565-acre Olinda Alpha Landfill (OAL) and ten closed solid waste disposal sites.
OAL was opened in 1960 to meet the solid waste disposal needs of the north portion
of Orange County.
OAL is permitted to accept waste until
2036 but is projected to fill over 95 percent of its capacity several years
before that date. Therefore, after December 2026 the site plans to accept only
public waste disposal due to the limited remaining airspace. CalRecycle
requires landfills to begin closure activities after two consecutive years of
tonnage intake rate that is equal to or less than 30 percent of its average
annual tonnage intake for the past 10 years. Because OAL plans on exceeding
this threshold, an extension request will be submitted to CalRecycle.
California Code of Regulations, Title 27 requires that a Final Closure and
Post-closure Maintenance Plan (FCPMP), including permit-level (80 percent)
design drawings, be approved by CalRecycle in order to grant an extension
request. Due to site settlement, final design drawings cannot be completed
until after final receipt of waste.
Two partial final closures, Phase 1 and
Phase 2, both designed by SWT Engineering, Inc.
were constructed and certified at OAL. Phase 1 covered 68.8 acres of the
lower front facing slopes and was completed in 2016. Phase 2 covered 88 acres
of the upper front facing slopes and was completed in 2019. This final closure
will cover the remaining 296.2 acres of refuse area. The contract will include
design of a soil and geomembrane cover layer, landfill gas collection system
modifications, grading, drainage, paving and other civil improvements. OCWR
does not have sufficient in-house resources nor the expertise to perform the
required design and permitting services.
On January 10, 2023, the Board approved
the establishment of a Qualified Vendors List (QVL) for Landfill Services. SWT
Engineering, Inc. is included as a qualified contractor on this QVL. These
services have been procured in accordance with the 2020 Design and Construction
Policy Manual, Section 3.3. The Orange County Preference Policy is not
applicable to this contract.
The contractor's performance has been
confirmed as at least satisfactory. OC Waste & Recycling verified there are
no concerns that must be addressed with respect to the contractor's
ownership/name, litigation status, or conflicts with County interests.
This contract includes subcontractors. See
Attachment B for information regarding subcontractors and the Contract Summary
Forms.
Compliance
with CEQA: This
project is not a project within the meaning of CEQA Guidelines Section 15378
and is there not subject to CEQA, since it does not have the potential for
resulting in either a direct physical change in the environment, or a
reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not
commit the County to a definite course of action in regards to a project since
the action authorized herein may lead to the execution of a contract. The proposed activity is therefore not
subject to CEQA. Any future action
connected to this approval that constitutes a project will be reviewed for
compliance with CEQA.
FINANCIAL IMPACT:
Appropriations for
this contract are included in the FY 2024-25 Budget for OCWR Capital Project,
Fund 273. The Contract includes a provision stating the Contract is subject to,
and contingent upon, applicable budgetary appropriations being approved by the Board
for each fiscal year during the term of this Contract. If such appropriations
are not approved, this Contract may be immediately terminated without penalty
to the County.
