RECOMMENDED ACTION(S):

 

 

1.

Approve stipend payment in the amount of $40,000 to Swinerton Builders for submitting a proposal for Design and Construction Services for the Orange County Health Care Campus at El Toro Project.

 

2.

Approve stipend payment in the amount of $40,000 to Snyder Langston, LLC for submitting a proposal for Design and Construction Services for the Orange County Health Care Campus at El Toro Project.

 

3.

Authorize and direct the Auditor-Controller or designee to make payments of $40,000 each to Swinerton Builders and Snyder Langston, LLC.

 

 

 

 

 

SUMMARY:

 

Approval of stipends will provide payment to contractors that provided a conceptual design submittal to the Request for Proposal for Design and Construction Services for the Orange County Health Care Campus at El Toro Project but were not awarded a contract.

 

 

 

BACKGROUND INFORMATION:

 

The proposed Orange County Health Care Campus at El Toro Project (Project) site is located in the City of Irvine (City) within the vicinity of the Orange County Great Park and within 20-minute walking distance from the Irvine Train Station. The site consists of two parcels, with Parcel 3 being approximately 4.38 acres and Parcel 4 being approximately 5.23 acres. One parcel is within the Lease in Furtherance of Conveyance area. The Project's vertical structure is an approximately 68,000 square-foot two-story building.

 

On February 2, 2022, OC Public Works issued Request for Qualifications documents for Design and Construction Services (Services) for the Project through the County of Orange (County) online bidding system. Six contractors responded and three were pre-qualified to submit a proposal in response to the County's subsequent Request for Proposals (RFP).

 

On March 17, 2022, OC Public Works issued an RFP for the Project to the prequalified contractors. The RFP was advertised on the County online bidding system. The RFP included a guarantee of a $40,000 dollar stipend to those respondents not awarded a contract. Responsive proposals from PCL Construction Services, Inc.; Snyder Langston, LLC; and Swinerton Builders were received and met the RFP requirements.

 

PCL Construction Services, Inc. and Snyder Langston, LLC were invited to participate in the oral evaluation. The evaluation panel consisting of two evaluators from OC Public Works, one evaluator from the County Executive Office (CEO) Real Estate, one evaluator from CEO Budget and one evaluator from the Health Care Agency scored the proposals and provided its recommendation that the Board of Supervisors (Board) award the contract to PCL Construction Services, Inc. (Contractor).

 

On November 29, 2022, the Board awarded Contract MA-080-23010085 (Contract) to the Contractor for Services for the Project.

 

The inclusion of a design stipend is a traditional component in complex design-build projects such as the Project, which included a bio-safety laboratory. A design stipend in the amount of $40,000 was explicitly incorporated into the RFP for each qualifying respondent who was not ultimately awarded the Contract. Approval of the stipend payment in the amount of $40,000 to each qualifying respondent not awarded the Contract was not included in the November 29, 2022, Board action.

 

Now that Project plans are more fully developed, OC Public Works is confident in moving forward with execution of the approved guaranteed maximum price with the Contractor as design-build entity. OC Public Works is recommending the Board approve the stipend payments to the non-selected/awarded respondents, Swinerton Builders and Snyder Langston, LLC, in the amount of $40,000 each, in accordance with the original procurement solicitation.

 

Compliance with CEQA:  This action is not a Project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item is for a stipend payment in accordance with the original procurement solicitation to each respondent not awarded the Contract. This proposed activity is therefore not subject to CEQA. Any future action connected to this approval that constitutes a Project will be reviewed for compliance with CEQA.

 

 

 

FINANCIAL IMPACT:

 

Appropriations are included in Budget Control 15D, Countywide Non-General Fund Capital Projects, FY 2023-24 Budget.
