RECOMMENDED ACTION(S):

 

 

1.

Adopt the list of prequalified contractors to bid on Job Order Contracts for General Building, Electrical, Mechanical, Roofing and Low Voltage Systems, Locks and Security Services.

 

2.

Adopt the May 2024 Job Order Contract Unit Price Book - Construction Task Catalog and Technical Specifications prepared by The Gordian Group, Inc., which are on file with the Clerk of the Board.

 

3.

Approve the Bid Documents for Job Order Contracts for General Building, Electrical, Mechanical, Roofing and Low Voltage Systems, Locks and Security Services, which are on file with the Clerk of the Board.

 

4.

Authorize the Clerk of the Board to advertise the Job Order Contracts for bids and set 2:00 PM. Pacific Time, August 21, 2024, as the time and date for the bid opening, unless extended pursuant to Public Contract Code Section 4104.5.

 

 

 

 

SUMMARY:

 

Approval of the Bid Documents and authorizing the Clerk of the Board to advertise Job Order Contracts for various contracting services will support expediting the completion of Sheriff-Coroner Department’s repair, remodeling, rehabilitation and maintenance projects and improve public safety and customer service.

 

 

 

BACKGROUND INFORMATION:

 

The Board of Supervisors (Board) has approved the establishment of a Job Order Contract (JOC) program to expedite completion of repair, remodeling and rehabilitation projects involving existing County facilities and structures. The JOC program includes a competitive public works bidding process based on a price adjustment factor that is multiplied by the unit prices of materials, equipment and labor established by the County's consultant, The Gordian Group, Inc. (Gordian). The Job Order Contract Unit Price Book and Technical Specifications (Price Book) were previously approved by the Board on June 27, 2023, as part of the Bid Documents. The Sheriff-Coroner Department (Sheriff) is requesting the Board to approve the updated Price Book dated May 2024, which is on file with the Clerk of the Board.

 

For over 25 years, Gordian has been a leading-edge construction procurement services company to public and private facility and infrastructure owners in North America that greatly benefit from Job Order Contracting's time and cost-saving advantages. Gordian has developed the necessary bid documents to seek contractors for public works projects. These documents include the technical specifications and prices for each task; the general JOC requirements, conditions, and details; the JOC Agreement; Notice to Contractors; and the Bid Proposal Form. The documents are all currently on file with the Clerk of the Board and have been in use with other County departments since 2010.

 

The purpose of the JOC program is to expedite services as defined by the Public Contract Code for maintenance, remodeling, rehabilitation, and repair work. These projects include major and minor repairs and replacements deemed necessary for the safe and efficient operation of Sheriff’s facilities. The current one-year JOC contracts for General and other construction specialty trade services were approved by the Board on September 26, 2023.

 

On March 11, 2024, pursuant to Section 6.1 of the County of Orange Design and Construction Procurement Policy Manual, Sheriff publicly advertised for Job Order Contracting Prequalification for General Building, Electrical, Mechanical, Roofing and Low Voltage Systems, Locks and Security Services in order to establish a list of prequalified firms that will be eligible to bid on the respective JOCs.

 

On April 1, 2024, Sheriff received prequalification submittals from the following firms:

Upon review of the prequalification submittals received by Sheriff’s independent, third party, Sheriff found that all of the above firms met the prequalification requirements, with the exception of the following four (4) firms that failed the prequalification requirements:

 

-Innovative Engineering Systems Inc dba Agilitech (Electrical Services)

-Siemens Industry Inc (Electrical Services)

-Innovative Engineering Systems Inc dba Agilitech (Low Voltage Systems, Locks,

        and Security Equipment Services)

-Siemens Industry Inc (Mechanical Services)

 

On May 2, 2024, Sheriff’s staff notified each contractor of the prequalification results. Firms that do not possess applicable current and valid license(s) at the time of bid will be disqualified from bidding.

 

As the current JOCs are expiring, Sheriff is requesting Board approval to advertise for bids to continue the JOC program for new one-year contracts. For the one-year contracts, contractors will be sought for General Building, Electrical, Mechanical, Roofing and Low Voltage Systems, Locks, and Security Equipment Services to allow for a capacity not to exceed $5.8 million each. Firms that submit the lowest composite price adjustment factors may be recommended to the Board for selection.

 

Compliance with CEQA:  This action is not a project within the meaning of the California Environmental Quality Act (CEQA) Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct or physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not commit the County to a definite course of action in regard to a project since it involves authorization to advertise for JOCs. This proposed activity is therefore not subject to CEQA. Any future action connected to this approval that constitutes a project will be reviewed for compliance with CEQA.

 

 

 

FINANCIAL IMPACT:

 

There is no financial impact associated with these Recommended Actions. However, after bids are received and evaluated, Sheriff will return to the Board for vendor selection. The funding source of each project will vary depending on the nature of the project. Routine maintenance projects will be funded from Budget Control 060, Sheriff-Coroner. Construction and facilities development projects will be included in Fund 14Q, Sheriff-Coroner Construction and Facility Development and will be potentially funded from Budget Control 060, Sheriff-Coroner or Budget Control 036, Capital Projects.
