RECOMMENDED
ACTION(S):
1. Authorize the
County Executive Officer or designee to execute the Memorandum of
Understanding between the County of Orange and the Superior Court of
California, Orange County for the Provision of Services for the term
beginning July 1, 2024, through June 30, 2025. |
2. Authorize the
County Procurement Officer or Deputized designee, to adjust the annual
contract amount to reflect any mid-year budget adjustments for County
contracts associated with this Memorandum of Understanding, pursuant to
Section 3.3-111 of the Contract Policy Manual. |
SUMMARY:
Approval of the Memorandum of
Understanding between the County of Orange and Superior Court of California,
County of Orange for Court and County mutual provision of services will fulfill
requirements of the Trial Court Funding Act.
BACKGROUND
INFORMATION:
In 1999, Assembly Bill 233 transferred the
Courts from the County of Orange’s (County) jurisdiction to the state, creating
the Superior Court of California, County of Orange (Court). Since that time,
the County and Court have entered into an annual Memorandum of Understanding
(MOU) for the mutual provision and compensation of services provided by or for
each other.
On June 6, 2023, the Board of Supervisors
(Board) approved modification agreements between the County and Court for the
exchange and compensation of various services for the term July 1, 2023,
through June 30, 2024.
The services provided by the County are
included in Attachment A of this Agenda Staff Report (ASR) detailed as
Attachments A through H within the MOU. The costs of the services provided by
the County are reimbursed by the Court and the estimated costs of these
services are included in Attachment C of this ASR detailed as Exhibit 1. The
actual revenue to the County will vary based on the Court's actual usage during
the year.
The services provided by the Court are
included in Attachment A of this ASR detailed as Attachments 1 through 10
within the MOU. The costs of the services provided by the Court are reimbursed
by the County and the estimated costs of these services are included in
Attachment C of this ASR detailed as Exhibit 1. The actual cost to the County
will vary based on County’s actual usage during the year.
This ASR seeks your Board’s approval for
the modified agreements between the County and Court for the exchange and
compensation of various services. The
County and Court have collaborated in order to update the MOU. The term of the
MOU for the Provision of Services between the County and Court is for July 1,
2024, through June 30, 2025.
FINANCIAL
IMPACT:
The MOU for County Services to the
Court and the Court Services to the County include estimated cost agreed upon
by both parties, and these amounts will be included in the FY 2024-25 Budget.
Budgets may be modified during the FY 2024-25 Mid-Year Budget adjustments to
reflect changes in the estimated cost agreed upon by both parties based on
actual usage of services. The estimated revenue to County departments through
payment for County provided service is $4,487,533; this does not include actual
costs to be charged to the Courts per the rates in Exhibit 1. The estimated
cost for Court-provided services to the County is $11,433,911 and is 100
percent Net County Cost; this does not include actual costs to be charged to
the County per Exhibit 1. Recommended Action No. 2 will provide authorization
to the County Procurement Officer or Deputized designee, to adjust the annual
contract amount to reflect any Mid-Year Budget adjustments as approved by the
Board without further Board action.
