RECOMMENDED ACTION(S):

 

 

1.

Find that the project is categorically exempt from CEQA, Class 1 (Existing Facilities) and Class 2 (Replacement or Reconstruction), pursuant to CEQA Guidelines, Section 15301 and Section 15302.

 

2.

Award a contract to West Coast Air Conditioning Company, Inc. for Design Phase Services and Construction Manager At-Risk Services for the Central Utility Facility Steam Line Replacement Project, in an amount not to exceed $97,700.

 

3.

Authorize the Director of OC Public Works or designee to execute the contract with West Coast Air Conditioning Company, Inc.

 

4.

Authorize return of bid guarantees to all bidders upon execution of the contract.

 

 

 

 

SUMMARY:

 

Award of a contract for Design Phase Services and Construction Manager At-Risk Services for the Central Utility Facility Steam Line Replacement Project will provide for a collaborative team effort on a design to restore the reliability of critical steam delivery from the Central Utility Facility to the Men and Women’s Jails, OC Sheriff-Coroner headquarters and Intake Release Center.

 

 

 

BACKGROUND INFORMATION:

 

The Central Utility Facility Steam Line Replacement Project (Project) is located at 525 N. Flower Street in Santa Ana. Due to the age (over 50 years) of the steam distribution and condensate collection system to the Men and Women’s Jails, OC Sheriff-Coroner headquarters and Intake Release Center, the steam/condensate system has experienced routine failures in providing steam as well as increased deferred maintenance expenses. Ongoing leaks contribute to high operation costs for additional gas usage and boiler feedwater makeup usage.

 

On December 28, 2021, OC Public Works issued a Request for Proposal for Design Phase Services and Construction Manager At-Risk (CMAR) Services (Services) for the Project. The CMAR delivery method was selected for this Project due to the level of coordination required with numerous stakeholders, constructability challenges and schedule constraints. The bid documents were advertised in several industry publications and on the County of Orange (County) online bid system. Two proposals were received and deemed responsive. The evaluation panel scored the responsive proposals. See Attachment D for the Summary of Evaluator’s Scoring. The resulting rankings are as follows:

OC Public Works is procuring Services for this Project in accordance with the 2020 Design and Construction Procurement Policy Manual, Section 5.6. The Orange County Preference Policy is not applicable to this contract award.

 

OC Public Works is recommending the Board of Supervisors (Board) award Contract MA-080-22010619 (Contract) with the Contractor for Services for the Project, in an amount not to exceed $97,700.

 

The proposed Contract for Services includes, but is not limited to, design and constructability review, cost estimating, project planning, value engineering and scheduling, assistance with permitting processes, selection of subcontractors/supplies and negotiation of a Guaranteed Maximum Price for Construction Phase Services, which is anticipated at approximately $4.2 million. OC Public Works will return to the Board with a proposed contract for Construction Phase Services at a later date. 

 

The Contractor’s license number was verified as current and active through the Contractors State License Board database on February 3, 2022. A copy of the verification is on file.

 

OC Public Works has conducted due diligence on the Contractor. Reference checks were satisfactory and completed with California State University, San Marcos; Poway Unified School District; and Fluor Corporation regarding similar projects/Services.

 

This Contract includes subcontractors. See Attachment B for information regarding subcontractors and Contract Summary Form.

 

Compliance with CEQA: The proposed Project is Categorically Exempt (Classes 1 and 2) from the provisions of CEQA pursuant to Sections 15301 and 15302 because it involves maintenance of existing public facilities, involving negligible or no expansion of the existing use and replacement or reconstruction of existing structures where the new structure will be located on the same site as the structure replaced and will have substantially the same purposed and capacity as the structure replaced.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this Contract are included in the FY 2021-22 Budget for Utilities, Budget Control 040.

 

The proposed Contract includes a provision stating the Contract is subject to and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
