RECOMMENDED ACTION(S):

 

 

1.

Find that the proposed project is categorically exempt from CEQA, Class 1 (Existing Facilities) pursuant to CEQA Guidelines, Section 15301.

 

2.

Authorize the County Procurement Officer or Deputized designee to execute an aggregate contract with Valley Cities Gonzales Fence, Inc. and Quality Fence Co., Inc. for Fence and Gate Repair/Maintenance Services, effective July 1, 2022, through June 30, 2025, in an aggregate amount not to exceed $5,145,000, with the option to renew for two additional years.

 

 

 

 

SUMMARY:

 

Approval of an aggregate contract for Fence and Gate Repair/Maintenance Services will allow OC Public Works to enhance public health and safety.

 

 

 

BACKGROUND INFORMATION:

 

The current workload for necessary Fence and Gate Repair/Maintenance Services (Services) exceeds the capacity of the County of Orange (County) workforce and utilizing contracted services will supplement resources to allow for timely repair of security elements on County roads and in Orange County Flood Control District facilities throughout Orange County.

 

An aggregate contract and subsequent renewals for Services with Valley Cities Gonzales Fence, Inc. and Quality Fence Co., Inc. (Contractors) were previously approved by the Board of Supervisors (Board) on June 6, 2017, May 5, 2020, and May 11, 2021.

 

On March 2, 2022, OC Public Works issued an Invitation for Bid for Services on the County online bidding system. Three bids were received and were deemed responsive. The lowest responsive, responsible bidders were deemed qualified to perform the needed Services. The Bid Summary is included as Attachment D.

 

OC Public Works is procuring these Services in accordance with the 2021 Contract Policy Manual Section 3.3-102.

 

The Orange County Preference Policy (OCPP) was applicable and incorporated into this solicitation; however, no OCPP qualified proposals were submitted.

 

OC Public Works is recommending the Board approve aggregate Contract MA-080-22010909 (Contract) with the Contractors for Services, effective July 1, 2022, through June 30, 2025, in an aggregate amount not to exceed $5.145 million, with the option to renew for two additional years upon Board approval. The work will be assigned to whichever contractor is available and, depending upon the request, work can be assigned to multiple contractors at the same time.

 

OC Public Works has conducted due diligence on the Contractors. Reference checks were satisfactory and completed with the following entities regarding similar Services.

The aggregate Contract does not currently include subcontractors or pass through to other providers. See Attachment C for Contract Summary Forms.

 

Compliance with CEQA: The proposed project is Categorically Exempt (Class 1) from the provisions of CEQA pursuant to Section 15301 because it involves maintenance and repair of existing public facilities, involving negligible or no expansion of the existing use.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for the aggregate Contract will be included in the FY 2022-23 Budget for the following fund numbers and will be included in the budgeting process for future years.

The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
