SUMMARY:
Approval of the California
Department of Corrections and Rehabilitation (CDCR) Agreement and Resolution
will allow youth supervised by the Probation Department who qualify, to
participate in the CDCR Pine Grove Youth Conservation Camp ("Fire Camp").
BACKGROUND
INFORMATION:
The California Department of
Forestry and Fire Protection (CALFIRE) and California Department of Corrections
and Rehabilitation (CDCR) jointly operate Pine Grove Youth Conservation Camp
(Pine Grove). Pine Grove provides housing, care, and training to County
youthful offenders. Camp partners include Amity Foundation and Anti-Recidivism
Coalition (ARC) which collaboratively instill a therapeutic community for youth
participating in the camp. Comprehensive rehabilitative program services are
uniquely designed to accommodate youth employment schedules, youth specific
needs, and address: Positive Reinforcement and Ethics, Criminal Addictive
Thinking, Violence Interruption and Knowledge, Motivational Incentives and
Success, Restorative Justice and Empathy, Substance Abuse Counseling, Reentry
and Reintegration services and Transitional Planning and Housing. Additional
program services include an athletic fitness/sports program, college
coursework, community service, religious services, and volunteer programs.
Individuals eligible for the
services under Senate Bill (SB) 823 are youth adjudicated for serious and/or
violent offenses under Welfare and Institutions Code § (WIC) 707(b), between
the ages of 14 and 17 years old at the time of the offense and are under the
jurisdiction of the juvenile court. Youth ages 18 to 25 who are not WIC §
707(b) offenders but are under the supervision of or housed by the Probation
Department may also be eligible for these services.
The overarching goal of Pine Grove
is to reduce incarceration, provide supportive programming, assist with
community reentry, and lower recidivism for the target population involved in
the juvenile justice system and is in direct alignment with the goals of the OC
CARES 2025 Vision.
The agreement between the County of
Orange and CDCR is capped at 10 youth to be housed at Pine Grove at any one time.
There is a cost to Probation of $81 per youth per day while in firefighting
training and $10 per day for each youth housed at Pine Grove. The youth will
receive 96 hours of training to receive six professional entry-level wildland
fire service certificates. It takes twelve days of training to receive these 96
hours. One certificate is received from CALFIRE and five additional
certificates are received from the National Wildfire Coordination Group.
Youth
eligibility will be determined by CDCR and County criteria. The agreement
requires that a medical, mental health and dental screening of the youth be
completed by the County and provided to CDCR for review and approval based on
the screening. The County is responsible for the transportation and associated
costs of the youth to and from Pine Grove. The County is responsible for the
transportation of the youth for local, state, and federal court appearances.
CDCR
provides basic healthcare to the youth consistent with services provided at
existing CDCR Fire Camps. Costs beyond basic healthcare, including but not
limited to, medical costs incurred prior to a youth’s return to the County, are
the responsibility of the County. The County performs all commitment time
calculations for youth while housed at Pine Grove and provides CDCR with an
initial release date and any changes to the release date to facilitate the
return of the youth to the County within 30 days of his/her release.
CDCR requires the County to adopt a
resolution to participate in Pine Grove Youth Conservation Camp, so Probation
requests the Board of Supervisors (Board) adopt the Resolution authorizing the
Chief Probation Officer or designee to execute agreements, amendments,
extensions, or documents with CDCR, as detailed in the Recommended Action.
Additionally, Probation requests that the
Board authorize the Chief Probation Officer or designee to execute the initial
agreement with CDCR, effective upon Board approval or execution of all
necessary signatures, whichever occurs later through and including June 30,
2026, in an amount not to exceed $112,320, as detailed in the Recommended
Action. Although the contract terms permit the contract to be extended
indefinitely upon agreement between CDCR and the County, Probation is
requesting Board authorization to extend for three additional one-year terms.
California Department of General Services (DGS) is CDCRs contract approval
authority. After CDCR receives the signed contract back from the County, along
with the required Resolution, it will be forwarded to DGS for final stamp and
signature of approval, at which point it will become effective.
As required by CDCR, the agreement
includes non-standard insurance and indemnification language. CEO Risk
Management has reviewed and approved Mutual Hold Harmless provision.
FINANCIAL
IMPACT:
The Contract is aligned with the
County’s OC CARES Initiative and addresses the needs identified by
Probation. Appropriations for the
Contract are included in Budget Control 057 FY 2023-24 and will be included in
the budgeting process for future years. Services within this Contract qualify
to be covered by SB 823 funds received from the State for the SB 823 eligible youth
population. Services will be provided to the youth who are not SB 823 eligible,
however, funding for services provided to that population will be covered by
department funds. The contract contains language that will allow for immediate
termination or modification without penalty if funding for the administration
of this contract were to be reduced and/or not available.
