RECOMMENDED ACTION(S):
Authorize the Director of OC Public Works or designee to execute a contract with Mark Thomas & Company, Inc. for Design Services for the OC Loop Segment O, P & Q Coyote Creek Channel, effective May 26, 2022, through May 25, 2027, in an amount not to exceed $5,487,343.
SUMMARY:
Approval of a Design Services contract with Mark Thomas & Company, Inc. for the OC Loop Segment O, P & Q Coyote Creek Channel project will improve bicycle safety and provide additional commuting and recreational opportunities for the community.
BACKGROUND INFORMATION:
The OC Loop connects and extends several regional bikeways to provide a continuous 66-mile loop around the northern portion of Orange County. The OC Loop Bikeway Concept Plan was envisioned initially within the 2009 Orange County Transportation Authority (OCTA) Commuter Bikeways Strategic Plan, later followed by the 2012 OCTA Fourth District Bikeways Strategy. OC Community Resources/OC Parks prepared the early bikeway improvement concept plans for the 2.7-mile OC Loop Segment O, P & Q Coyote Creek Channel project (Project) to address bikeway discontinuity between existing segments of the well-used Coyote Creek Channel bikeway (2015 OC Loop Gap Feasibility Study). Currently the OC Loop is 88 percent complete.
The Project begins at the existing Coyote Creek Bikeway in the City of Cerritos at the confluence of the west and east Coyote creeks and runs partially through the cities of La Mirada and Buena Park, connecting to the existing Coyote Creek Bikeway segment at La Mirada Boulevard/Malvern Avenue in the City of La Mirada.
On May 25, 2021, the Project was approved by the Board of Supervisors (Board) as part of the OC Public Works 7-Year Capital Improvement Program (CIP).
On October 15, 2021, OC Public Works issued a Request for Proposals (RFP) for Design Services (Services) for the Project. The RFP was advertised on the County of Orange (County) online bidding system. Three proposals were received and were deemed responsive. The evaluation panel scored the responsive proposals. Invitations to participate in oral interviews were issued to Mark Thomas & Company, Inc., Michael Baker International, Inc. and GHD, Inc. See Attachment D for the Summary of Evaluators Scoring. The resulting ranking is as follows:

OC Public Works is procuring Services for this Project in accordance with the 2020 Design and Construction Procurement Policy Manual, Section 3. The Orange County Preference Policy is not applicable to this contract award.
OC Public Works recommends that the Board approve Contract MA-080-22011119 (Contract) with Mark Thomas & Company, Inc. (Contractor) for Services for the Project, effective May 26, 2022, through May 25, 2027, in an amount not to exceed $5,487,343. The five year Contract term accounts for the likely sequential construction execution of each segment in the CIP construction schedule for FY 2023-24, FY 2024-25 and FY 2025-26, the extensive California Public Utilities Commission and multi-agency permitting requirements and the fact that construction grant funds for Segments P and Q are still being sought (next Active Transportation Program cycle notification likely on June 23, 2022).
The Contractor's license number was verified as current and active through the Department of Consumer Affairs database on November 17, 2021. A copy of the verification is on file.
OC Public Works has conducted due diligence on the Contractor. Reference checks were satisfactory and completed with the cities of Eastvale, Yorba Linda and the Port of Los Angeles.
This Contract includes subcontractors. See Attachment B for information regarding subcontractors and Contract Summary Form.
Compliance with CEQA: This Contract is a necessarily included element of the Project considered in the Final Mitigated Negative Declaration (MND) No. PP 18-145, adopted by the Board on October 19, 2021, for the Project, which adequately addressed the effects of the proposed Project. No substantial changes have been made in the Project, no substantial changes have occurred in the circumstances under which the Project is being undertaken and no new information of substantial importance to the Project, which was not known or could not have been known when the Final MND No. PP 18-145 was approved has become known; therefore, no further environmental review is required.
FINANCIAL IMPACT:
Appropriations for this Contract will be encumbered and are included in the FY 2021-22 Budget for OC Public Works CIP Fund 174.
On December 9, 2021, the California Transportation Commission approved the allocation of $1.415 million in Federal Active Transportation Grant funding to partially pay for the design of the Project. The Project segments are included and scheduled in the approved CIP List for FY 2021-22 through FY 2026-27.
The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of the Contract. If such appropriations are not approved, the Contract may be immediately terminated without penalty to the County.
