RECOMMENDED ACTION(S):

 

 

1.

Reappoint Martin Schwarz to the postion of Public Defender, effective May 10, 2024, through May 9, 2027.

 

2.

Approve and execute the First Amendment to the agreement for the employment of the Public Defender, effective May 10, 2024, through May 9, 2027, at an annual salary of $300,768 and an estimated total compensation of $486,366 including benefits.

 

 

 

 

SUMMARY:

 

Approval of the Agreement will allow the Chairman of the Board to execute, on behalf of the Board of Supervisors, the attached three-year agreement for the employment of the Public Defender.

 

 


 

 

BACKGROUND INFORMATION:

 

A three-year agreement with Martin Schwarz for employment as the the Public Defender was executed on May 11, 2021, and will expire on May 10, 2024.

 

Mr. Schwarz has served as Public Defender at the County of Orange Public Defender's Office since May, 11, 2021. In addition, he has worked in the Public Defender's office for over 20 years.  He earned his Juris Doctor degree from the University of San Francisco of Law and a Bachelor of Arts degree from the University of California at Santa Barbara.  He is a member of the California State Bar Association, Orange County Criminal Justice Coordinating Council, Integrated Law and Justice Agency for Orange County and Countywide Integrated law and Justice.

 

 

 

FINANCIAL IMPACT:

 

The negotiated salary for Mr. Schwarz is $300,768 ($144.60 per hour). Incuding the cost of benefits, the total annual cost to the County is anticipated to be $486,366. Salary and benefit appropriations are inlcuded in Public Defender, Budget Control 058, FY 2023-2024 Budget and will be included in the budgeting process for future years.
