RECOMMENDED ACTION(S):

 

Appoint David Sanchez as the Orange County Public Guardian in accordance with Government Code, Section 27430 et.seq., effective upon Board’s approval.

 

 

 

 

SUMMARY:

 

Appointment of David Sanchez as the Orange County Public Guardian who will provide leadership of the Public Guardian Office to provide conservatorship services to Orange County residents.

 

 

 

BACKGROUND INFORMATION:

 

The Public Guardian is responsible for the care of individuals who are no longer able to make decisions or care for themselves. Establishing a public guardian or a conservatorship is a legal process where a third party (conservator) is given the legal authority to manage the financial affairs and/or the care of another individual (conservatee). The Public Guardian is deemed as the "conservator of last resort," meaning that all other viable alternatives need to be considered before the Public Guardian is granted the Conservatorship of an individual.

 

On February 4, 2014, the Board approved Ordinance 14-001 Option 2 consolidation which resulted in the Public Guardian’s Office being moved within the Health Care Agency’s (HCA) organizational structure.

The Public Guardian vacated the position in October 2023, and since then an Interim Public Guardian has been in place. HCA Human Resource Services completed a recruitment for the Public Guardian, Business Manager Senior position beginning November 14, 2023, and ending February 27, 2024. The recruitment was open for 105 days and a total of 47 applications were received. Two candidates were interviewed by a Selection Interview panel. The panel recommended David Sanchez as the most qualified person to fill this position. His starting salary will be $65.34 per hour.

 

Mr. Sanchez possesses an excellent background to fill the position of Public Guardian. He has been with the County of Orange Office of the Public Guardian for six years and has experience working as a Deputy Public Guardian II, Senior Deputy Public Guardian, and Supervising Deputy Public Guardian and is currently the Interim Public Guardian.

 

The Health Care Agency recommends that the Board appoint David Sanchez as the Orange County Public Guardian as referenced in the Recommended Action.

 

 

 

FINANCIAL IMPACT:

 

 

Appropriations for the Public Guardian position are included in the FY 2023-24 Budget and will be included in the budgeting process for future years.
