RECOMMENDED
ACTION(S):
Authorize the County Procurement
Officer or Deputized designee to execute Amendment No. 1 to renew the aggregate
contracts with J. Orozco Enterprises Inc. dba Orozco Landscape and Tree Company
and Natures Image, Inc. for Channel Cleaning Services, effective June 10, 2024,
through June 9, 2025, in an aggregate amount not to exceed $1,000,000 for a new
cumulative total amount not to exceed $4,000,000, renewable for one additional one-year term upon Board of
Supervisors approval.
SUMMARY:
Approval of renewals to the
aggregate contracts for Channel Cleaning Services will allow OC Public Works to
provide necessary resources for the County of Orange and Orange County Flood
Control District to maintain flood control capacity, rights-of-way and reduce
run-off water pollution.
BACKGROUND
INFORMATION:
In accordance with the Flood
Control Maintenance Program, OC Public Works conducts annual cleaning of flood
control facilities to maintain capacity and rights-of-way and reduce pollutants
downstream. The work consists of removal of trash, debris, obstructions and
silt from flood control channels and basins. This effort also includes trimming
and clearing of vegetation along access roads, slopes, inverts, expansion
joints, weep holes and side inlets.
On March 1, 2021, OC Public Works
issued an Invitation for Bid for Channel Cleaning Services (Services) on the
County of Orange (County) online bidding system. The Orange County Preference
Policy (OCPP) was applicable and incorporated. One OCPP qualified bid was
submitted. OC Public Works recommended award of contracts to the two lowest
responsive bidders, J. Orozco Enterprises Inc. dba Orozco Landscape and Tree
Company and OCPP-qualified contractor Natures Image, Inc. (Contractors).
On May 25, 2021, the Board of
Supervisors (Board) approved aggregate Contracts MA-080-21011342 (Contracts)
with the Contactors for Channel Cleaning Services (Services), for a three-year
term effective June 10, 2021, through June 9, 2024, in an aggregate amount not
to exceed $3 million.

OC Public Works is proposing to
continue procuring these Services in accordance with the 2021 Contract Policy
Manual Section 3.3-102.
OC Public Works is recommending
Board approval to renew Contracts with the Contractors for Services, effective
June 10, 2024, through June 9, 2025, in an aggregate amount not to exceed $1
million, for a new cumulative total amount not to exceed $4 million, renewable
for one additional one-year term upon Board approval. The requested renewal of
the existing contracts does not expand the scope of services to be provided by
the Contractors. The previously approved amount does not roll over to the
renewal term. The work is assigned to whichever Contractor is available and,
depending upon the request, work can be assigned to both Contractors at the
same time.
The Contractors’ respective
performances have been confirmed as satisfactory. OC Public Works has verified
there are no concerns that must be addressed with respect to Contractors’
ownerships/name, litigation status or conflicts with County interests.
The Contracts do not include
subcontractors or pass through to other providers. See Attachment C for the
Contract Summary Forms.
Compliance
with CEQA:
The proposed project was previously determined to be Categorically Exempt from
CEQA pursuant to CEQA Guidelines Section 15301 (Class 1) on May 25, 2021, when
it was originally approved because it involves a Contract for Services to
support maintenance of existing flood control channel facilities in the
unincorporated areas of Orange County and its cities. The proposed project is
still consistent with this determination.
FINANCIAL
IMPACT:
Appropriations for the Contracts
are included in Fund 400, OC Flood, FY 2023-24 Budget and will be included in
the budgeting process for future years.
The Contracts include a provision stating
the Contracts are subject to, and contingent upon, applicable budgetary
appropriations being approved by the Board for each fiscal year during the term
of the Contracts. If such appropriations are not approved, the Contracts may be
immediately terminated without penalty to the County.
