RECOMMENDED ACTION(S):

 

Approve the recommended revision to the Bylaws for the Orange County Commission to End Homelessness allowing the Orange County District Attorney to designate a proxy representative to attend the Commission meetings, to fulfill the required member representation and provide adequate member attendance to vote and meet quorum for voting items.

 

 

 

 

SUMMARY:

 

The proposed Commission to End Homelessness Bylaw revision allows the Orange County District Attorney to designate a proxy voter at the Commission to End Homelessness meetings to ensure representation and engagement by the Orange County District Attorney office at Commission meetings.

 

 

 

BACKGROUND INFORMATION:

 

The Commission to End Homelessness (Commission) serves as a collaboration of County government, city government, philanthropic, business-sector, community and faith-based organizations, and other key stakeholders to focus on regional policy and implementation strategies, affordable housing development, data and gaps analysis, best practice research, social policy, and systemic change to promote an effective response to homelessness within Orange County.

The Orange County District Attorney (OCDA) currently is a member of the Commission, and the proposed amendment will allow the OCDA to designate a substitute to attend the Commission meeting on their behalf. The designee will be able to vote by proxy on any action items and OCDA will inform the Commission Chair on who the designee is prior to the start of the meeting.

 

The proposed revision to the Bylaws was previously presented to and approved by the Commission on February 16, 2022. On April 12, 2022, the Board approved the Commission Bylaw revision to allow the OCDA to designate a proxy representative.

 

On October 17, 2023, the County Executive Office brought additional recommended revision to the Commission Bylaws to the Board for approval. Due to an administrative oversight, the previously approved revision from April 12, 2022, did not include Orange County District Attorney to designate a proxy. The following reflects the proposed revision under Article IX.D:

Members of the BOS, and the Orange County District Attorney who serve as Commission Members may designate a substitute to attend a Commission meeting on their behalf and vote on any action item by submitting the Member’s signed proxy to the Commission Chairperson at the start of the meeting.

 

As such, the County Executive Office requests the Board approve the proposed revision to the Bylaws as referenced in the Recommended Action above to re-add this critical language that would allow OCDA to designate a proxy voter at the Commission meetings to ensure representation and engagement by the OCDA.
