RECOMMENDED
ACTION(S):
Authorize the County Procurement
Officer or Deputized designee to execute Contract with Axon Enterprise, Inc.
for Taser Equipment and Supplies for the term of March 1, 2024, through
February 28, 2025, in the amount not to exceed $30,000, renewable for two additional
one-year terms.
SUMMARY:
Approval of the Contract with Axon
Enterprise, Inc. will allow the Office of the District Attorney/Public
Administrator to acquire new and updated Taser Equipment and Supplies for its
operations use during case investigations.
BACKGROUND
INFORMATION:
The Office of the District
Attorney/Public Administrator (OCDA) requires a Contract to purchase Taser
Equipment and Supplies to provide to its Bureau of Investigation's staff for
use during case investigations. Purchase of Taser Equipment and Supplies is necessary
to provide investigators when responding to dangerous and threating situations
during the course of their duties.
OCDA requests Board approval of
Contract MA-026-24010075 with Axon Enterprise, Inc. for Taser Equipment and
Supplies for the term of March 1, 2024 through February 28, 2025, renewable for
two additional one-year terms, in the amount not to exceed $30,000. This
Contract is Subordinate to Cooperative Master Agreement #3544-21-4615 with Axon
Enterprise, Inc. through Omnia Partners, University of Nebraska.
This Contract includes non-standard
terms and conditions. County Executive Office/Risk Management has reviewed
these terms and determined that they do not pose a significant risk to the
County. The non-standard terms do not affect insurance limits or defective
product exposure. An approved Risk Assessment or Modification of Insurance
Terms Form is attached (Attachment C). As this Contract includes non-standard
terms and conditions, Board approval is required.
The Orange County Preference Policy
is not applicable to this Contract Award.
Subcontractors
This Contract does not currently include
subcontractors or pass through to other providers. See Attachment B for
Contract Summary Form.
FINANCIAL
IMPACT:
Appropriations and Revenue for this
Contract are included in the District Attorney’s FY 2023-24 Budget for Budget
Control 026 and will be included in the budgeting process for future years as
needed. This Contract contains language allowing the District Attorney
to terminate the contract or reduce the level of services without penalty with
cause or without cause in the event that funding is reduced and/or not
available to continue funding the Contract.
