RECOMMENDED
ACTION(S):
Authorize the Director of OC Public
Works or Deputized designee to execute Amendment No. 1 to extend the contract
with Lionakis for Architect and Engineering Services to include Phase 2
Redevelopment of Juvenile Hall and Adult Re-Entry Center at the former Youth
Guidance Center, for a term of four years, effective upon Board of Supervisors
approval, and to increase the maximum allowable compensation by $810,125, for a
cumulative total amount not to exceed $2,873,359.
SUMMARY:
Approval of Amendment No. 1 to the
contract for Architect-Engineering Services will provide Master Planning to
support the Phase 2 Redevelopment and will define the steps necessary to
redevelop the Orange County Juvenile Hall and transform the former Youth
Guidance Center into an Adult Re-Entry Center to provide state-of-the-art
facilities for both the juveniles and adults served.
BACKGROUND
INFORMATION:
In 2021, the County Executive Office and
the Orange County Criminal Justice Coordinating Council, in alignment with the
objectives of the County of Orange’s (County) OC Cares initiative, and
responding to the decreasing number of youth in custody due to OC Probation's
(Probation) robust efforts in developing alternatives to incarceration, has
made a strategic decision to repurpose current Probation facilities. This
redevelopment also serves to address the growing need for services, especially
housing services, experienced by the adult justice-involved population. This
plan includes multiple phases, with construction occurring simultaneously
regardless of phase.
Development Phases and Projects:
Phase 1
The first phase of the project will be the
redevelopment of Orange County Juvenile Hall (OCJH) to include a new Youth
Transition Center (YTC). Many of the youth who will receive services at the new
YTC are currently housed offsite at the Youth Guidance Center (YGC).
These redevelopment improvements will
enhance the existing OCJH site, which is currently a 434-bed juvenile custodial
facility at 331 The City Drive, Orange, CA 92868. The YTC will be established
to meet or exceed the requirements for a juvenile detention facility and to
meet the needs of the current and future populations in a nurturing
environment, significantly enriching the lives of up to 68 male and female
youth. As a self-contained entity within the OCJH, the YTC will not only meet
functional requirements but also serve as a beacon of rehabilitation and
growth, all while adhering to the stringent standards set forth by the County
of Orange Architect-Engineer Guide.
The YTC will provide the following
programs: Behavioral Health Services, Culinary Program, Education Program,
Medical Health Services and Vocational Programs. All programs are to be housed
within the following planned facilities: Administration, Facility Support and
Storage, Kitchen and Dining for residents and staff, Living Units (60 beds),
Staff Break and Wellness Areas and an independent Transitional Living Unit. The
project includes demolition of several occupied and unoccupied buildings,
including existing housing units A, I, R, S, M, O and G through K, perimeter
security fencing, modifications to existing access drives and construction of
additional parking areas at the existing site, amenities, and landscaping, including many existing mature trees, which
shall remain if possible.
Probation will coordinate relocating the
existing YGC youth and staff to the new YTC, when it is ready for occupancy in
early 2026.
Phase
2
The second phase of the project will be
the conversion of the existing 125-bed YGC facility at 3030 North Hesperian,
Santa Ana, CA 92706, into the Adult Re-Entry Center (ARC).
These redevelopment improvements include
approximately 88,000 gross square feet of new building area, additional site
access, new parking areas, outdoor recreation and landscape development.
Clients will be transported directly to this facility from Juvenile Hall.
Contract Expansion:
On August 30, 2022, OC Public Works issued
Contract Administration-Project Management Services MA 080-22010953 and
Contract Task Order LION-01.00-OCPW22 to Lionakis (Contractor) authorizing the
Contractor to proceed with Criteria Document Development Services for Phase 1
through Phase 3. The Contractor and the consulting engineers and design
professionals comprising the Criteria Documents Team developed program-based
Criteria Documents, including validation and final development of functional
space programming, architectural programming, conceptual layouts, adjacency
diagrams and systems narratives for the YTC to be located on the OCJH facility.
On September 15, 2022, OC Public Works
issued a Sole Source document to the Contractor for Criteria Documents Phase 4
- Construction Administration, for OCJH YTC through the County online bidding
system.
On November 8, 2022, the Board of
Supervisors (Board) approved Contract MA-080-23010374 with the Contractor for
Architect and Engineering Services for Criteria Documents Phase 4 -
Construction Administration, OCJH YTC.
On December 19, 2023, the Board approved
Contract MA-080-23011507 with Balfour Beatty Construction LLC for Design and
Construction Services and Contract MA-080-24010362 with Vanir Construction
Management, Inc. for Construction Management Services for the YTC.
OC Public Works is now recommending Board
approval to authorize the Director of OC Public Works or designee to execute
Amendment No. 1 to extend Contract MA-080-23010374 (Contract) with the
Contractor for Architect and Engineering Services for the ARC, for a term of
four years, effective upon Board approval, to increase the maximum allowable
compensation by $810,125, for a cumulative total amount not to exceed
$2,873,359. This Amendment shall provide for data collection and condition
assessment, planning/programming sessions for master plan development support
for Phase 2 of the redevelopment. Data collection and condition assessment will
include development of the base drawing of the facility, kick-off meeting with
OC Public Works and Probation to discuss project expectations, review of existing
building As-Builts, site assessment, building assessment, site visits with
sub-consultants and conducting maintenance and facilities meetings regarding
systems and utility needs. A contract for environmental review will be
separately bid and awarded once the project is designed to a level that will
allow for informed environmental review. This Amendment does not include
environmental review.
The Contractor is based in Sacramento.
This Contract includes subcontractors. See Attachment C for Contract Summary
Form.
Compliance
with CEQA: This
action is not a project within the meaning of CEQA Guidelines Section 15378 and
is therefore not subject to CEQA, since it does not have the potential for
resulting in either a direct physical change in the environment, or a
reasonably foreseeable indirect physical change in the environment. The
approval of this agenda item does not commit the County to a definite course of
action in regard to a project since the approval entails a consultant contract
to assist with developing design criteria aspects for the YTC, which is
necessary to allow for environmental review. A CEQA review for the Project
after design will occur through a separate contract. This proposed activity is
therefore not subject to CEQA. Any future action connected to this approval that
constitutes a project will be reviewed for compliance with CEQA.
FINANCIAL
IMPACT:
Appropriations for
this Contract are included in Countywide Capital Projects Non-General Fund 15D
for FY 2023-24 budget and will be included in the budgeting process for future
years.
The proposed Contract includes a provision
stating that the County has the right to terminate this Contract for cause upon
10 days written notice and at any time and without cause upon not less than
seven calendar days' written notice without penalty to the County.
