RECOMMENDED ACTION(S)
1. Find that: (i) Final EIR 582 and Addendum 582-1, as revised by
Final Supplemental EIR 582, previously certified on June 25, 2002, accepted on
December 10, 2002, and certified on October 19, 2004, respectively, have been
examined in relation to the proposed project; (ii) the proposed project's
environmental effects were fully analyzed and disclosed in these CEQA documents
and the proposed project would not have any environmental effects beyond those
analyzed and disclosed in these environmental documents; (iii) no further CEQA
compliance is required for the proposed project.
2. Approve and authorize the Chair of the Board to execute the original and duplicate Certificated Passenger Airline Leases with Aloha Airlines, America West Airlines, Continental Airlines, Inc., Delta Air Lines Inc., Frontier Airlines, Inc., and United Airlines, Inc.; the Cargo Lease with United Parcel Service Co.; and the Commuter Airline Operating License with Skywest Airlines, Inc., and return the duplicate copies to John Wayne Airport upon notification from the Airport Director that all deposits, insurance and all access plan requirements have been met.
3. Approve unexecuted Certificated Passenger Airline Leases with
Alaska Airlines, American Airlines, Southwest Airlines, and Northwest Airlines;
the Certificated Passenger Airline Operating License with Mesa Airlines; the
Cargo Lease with Federal Express; and the Commuter Airline Operating License
with American Eagle Airlines in the form attached subject to receipt of fully
executed leases and licenses by the Airport Director and authorize the Chair of
the Board to execute said leases and licenses upon delivery of signed original
and duplicate copies to the Clerk of the Board.
SUMMARY:
Approve the Certificated Passenger Airline Leases, Certificated Passenger Airline Operating License, Cargo Leases and Commuter Airline Operating Licenses.
BACKGROUND INFORMATION:
The ASR requests Board approval of Certificated Passenger Airline Leases, Certificated Passenger Airline Operating License, Cargo Leases and Commuter Airline Operating Licenses (all collectively referred to as Agreements). Approval of these Agreements will allow the various Commercial Airlines, Cargo Carriers and Commuter Airlines (all collectively referred to as Carriers) serving John Wayne Airport to continue operations.
The current Agreements with the Carriers will expire on December 31, 2005. The new Agreements will be effective January 1, 2006 and will be for a term of approximately five (5) years, expiring on March 31, 2011.
Alaska Airlines, American Airlines, Southwest Airlines, Northwest Airlines, Mesa Airlines, American Eagle Airlines and Federal Express are processing the attached Agreements through their corporate structure. They have notified us that they will be able to execute the Agreements in the form attached, but are unable to process and return them to us in time to submit the executed Agreements to the Clerk of the Board by the December 5th filing date. Therefore, the Airport is requesting the Board approve the Agreements as attached subject to receipt of the fully executed Agreements and authorize the Chair of the Board to execute the original and duplicate Agreements upon delivery to the Clerk of the Board by the Airport Director.
CEQA Compliance:
Final EIR 582, Addendum 582-1 and Final Supplemental EIR 582 previously certified on June 25, 2002, accepted on December 10, 2002, and certified on October 19, 2004, respectively, have been prepared for the Settlement Agreement Amendment and Settlement Amendment Implementation Plan ("proposed project"). Your Board is required to examine the subject project to determine whether its environmental effects were fully analyzed and disclosed in these previous CEQA documents and whether the subject project would have any environmental effects beyond those analyzed and disclosed in the previous environmental documents. If your Board concurs, no further CEQA compliance is required as noted in Recommended Action #1.
Legal Requirements:
Resolution No. 86-1552, dated December 10, 1986, exempted John Wayne Airport Master Plan Projects from the zoning code.
FINANCIAL IMPACT:
The Airline Agreements are projected to generate approximately $129,815,720 of revenue during the term of the Agreements.
