RECOMMENDED ACTION(S):
Authorize the County Procurement Officer or authorized Deputy to execute sole source contract with Pen-Link Ltd. for one-time purchase and installation of wire intercept equipment, effective upon Board of Supervisors approval and execution of all necessary signatures, in a not to exceed amount of $161,689.79.
SUMMARY:
Approval of the sole source contract with Pen-Link Ltd. will allow the Sheriff-Coroner Department to purchase and install wire intercept equipment used for intelligence purposes.
BACKGROUND INFORMATION:
The Regional Narcotics Suppression Program (RNSP) is a multi-agency task force administered by the Sheriff-Coroner Department (Sheriff). RNSP works to target, investigate and prosecute subjects involved in large scale narcotics trafficking and money laundering. Seized illegal proceeds are returned to participating local agencies in the way of civil asset forfeiture. The offices of RNSP have a Pen-link software system installed in the wiretap room that provides for the collection, storage and analysis of telephone and internet communications for investigative purposes. With a court order, RNSP may wiretap phone lines and internet communication for investigative purposes in support of narcotics trafficking and money laundering cases. With the advent of new technologies, the current equipment and software is dated. The purchase order contract for the one-time purchase and installation of wire intercept equipment will increase the system's capacity for internet intercept of information.
The vendor, Pen-Link Ltd. (Pen-Link), is the only vendor to provide the Lincoln wire interface system along with the compatible and seamless software that supports case management and analytical functionality. Lincoln is a "Law Enforcement Only" system which enables the electronic monitoring of investigative targets via wiretap. Pen-Link will provide servers, workstations and all peripherals that comprise this wiretap system as well as the necessary analytical software compatible with the Lincoln system and only produced by Pen-Link. Pen-Link has provided maintenance and support of the current equipment. The proposed contract is a sole source contract and a completed Sole Source Request Form is attached to this Agenda Staff Report (Attachment B).
The Sheriff requests Board of Supervisors (Board) approval for County Procurement Officer or authorized Deputy to execute sole source contract with Pen-Link for one-time purchase and installation of wire intercept equipment, effective upon Board approval and upon execution of all necessary signatures, in a not to exceed amount of $161,689.79. This contract does not include subcontractors or pass through to other providers. See Attachment C for Contract Summary.
This vendor has performed satisfactorily in the past with similar contracts. On November 14, 2017, the Board approved a contract with Pen-Link contract for the software system that provides for the collection, storage, and analysis of telephone and internet communications for investigative purposes, for the period of July 1, 2017 through June 30, 2018, in the annual not to exceed amount of $43,499. Additionally, on June 26, 2012, the Board approved a five-year contract with Pen-Link for the period of July 1, 2012 through June 30, 2017, in a total not to exceed amount of $197,237, for the software system that provides for the collection, storage, and analysis of telephone and internet communications for investigative purposes.
FINANCIAL IMPACT:
Appropriations for the contract are included in the Sheriff-Coroner’s FY 2018-19 Budget, Budget Control 126, Regional Narcotics Suppression Program. The contract contains language allowing the Sheriff-Coroner Department to terminate the contract without penalty with cause or after 30 days of written notice without cause in the event that funding is reduced and/or not available to continue funding the contract.
