RECOMMENDED ACTION(S):
Approve the proposed Employee Lactation Accommodation Policy to be effective January 1, 2020.
SUMMARY:
Approval of the proposed Employee Lactation Accommodation Policy will ensure that a nursing County employee’s lactation accommodation needs are being met in accordance with California law and in connection with the County’s non-discrimination policy.
BACKGROUND INFORMATION:
On October 8, 2019, the Board of Supervisors (Board) directed the County Executive Officer (CEO) to formally develop a County of Orange Lactation Policy and return to the Board in 90 days. Additionally, the proposed Employee Lactation Accommodation Policy will be enacted pursuant to Labor Code Sections 1030-1034 as amended and added by California Assembly Bill No. 1976, Chapter 940, and Senate Bill No. 142, Chapter 720, relating to employment.
The County of Orange recognizes that breast milk is the optimal food for growth and development of infants. In order to promote a work environment that supports breastfeeding, the County is dedicated to providing a reasonable amount of break time and a private space for employees who wish to express breast milk at work. Lactation accommodation will be provided to employees for as long as they desire to express breast milk at work. The proposed Employee Lactation Accommodation Policy lists the parameters in which departments can provide appropriate accommodations in accordance with the law.
At the direction of the Board, the CEO’s office has identified all current lactation rooms at County facilities available for County employees. The list for employee lactation rooms can be found on the
Human Resource Services Portal within the Resources tab:

The list of lactation rooms for the general public can be found on the County’s website: http://www.ocgov.com/default.asp. County Staff will assist the public with lactation room reservations.
Additionally, the CEO’s office will identify County facilities where dedicated lactation rooms should be added or improved, considering the nature of facilities and the amount of traffic they experience from employees and members of the public.
