RECOMMENDED ACTION(S):

 

 

1.

Find that the subject activity is not a project within the meaning of the California Environmental Quality Act Guidelines Section 15378 and is therefore not subject to review under the California Environmental Quality Act.

 

2.

Approve and execute Amendment No. 1 to the Architect-Engineer Agreement with AECOM Technical Services, Inc. in the amount of $817,306, for a new total contract amount of $3,808,620, to extend the Agreement term for two years, effective January 1, 2020, to December 31, 2021, for the preparation, review and approval of an Airport Layout Plan Narrative Report, Exhibit ‘A’ Airport Property Inventory Map and Airport Geographic Information Systems.

 

 

 

 

SUMMARY:

 

Approval of Amendment No. 1 with AECOM Technical Services, Inc. will allow for the preparation of the Airport Layout Plan Narrative Report, Exhibit ‘A’ Airport Property Inventory Map and Airport Geographic Information Systems that are required for Federal Aviation Administration approval of the Airport Layout Plan and the General Aviation Improvement Program.

 

 

 

BACKGROUND INFORMATION:

 

On June 28, 2016, the Board of Supervisors (Board) approved the selection of AECOM as the primary firm and C&S Companies as the alternate firm for the General Aviation Improvement Program preliminary engineering; and the selection of Landrum & Brown as the primary firm for the General Aviation Improvement Program CEQA and NEPA document preparation.

 

On September 27, 2016, the Board approved an agreement with AECOM Technical Services, Inc. (AECOM) to provide services related to the General Aviation Improvement Program (GAIP). Due to the size of the GAIP, an Airport Layout Plan (ALP) update was included in AECOM’s original scope of work. Title 49 of the United States Code, Section 47107(a)(16) requires John Wayne Airport (JWA) to maintain a current ALP. Section 47107 also prohibits JWA from altering the airport unless the Federal Aviation Administration (FAA) Airports District Office (ADO) has determined that the project will not adversely affect the safety, utility and efficiency of the airport. After AECOM was awarded the agreement, meetings with the ADO clarified that an ALP Narrative Report, Exhibit ‘A’ Airport Property Inventory Map, and Airport Geographic Information System would be required in addition to the ALP update in order to qualify for FAA funding. Consequently, JWA pursued and secured an FAA Grant accordingly and on July 16, 2019, the Board approved a grant award of $886,490 from the FAA with a County match of $213,510 for a total of $1.1 million.

 

The total negotiated amount to complete the above-described work is $1,120,537, and with only $303,231 remaining in the original contract scope, JWA is requesting to increase the contract amount by $817,306. To provide adequate time for the additional scope of work to be completed, Amendment No. 1 will also extend the original contract term by two years to December 31, 2021.

 

Based on the preceding information, JWA seeks Board approval of Amendment No. 1 and a contract extension with AECOM. The Agreement includes subcontractors. See Attachment C for information regarding subcontractors and the Contract Summary Form. 

 

Compliance with CEQA:  This action is not a project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to CEQA since it does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment.  The approval of this agenda item does not commit the County to a definite course of action regarding a project since the proposed project involves the approval of the Architect-Engineer Agreement.  This proposed activity is, therefore, not subject to CEQA.  Any future action connected to this approval that constitutes a project will be reviewed for compliance with CEQA. 

 

 

 

FINANCIAL IMPACT:

 

Appropriations for the amendment are included in the FY 2019-20 Budget for Airport Construction Fund 281 and will be included in the budgeting process for future years. 

 

The amendment contains language which allows JWA to terminate the amendment, reduce the level of services and/or renegotiate the levels of services to be provided.
