RECOMMENDED ACTION(S):

 

Authorize the Sheriff-Coroner or authorized designee to execute the Memorandum of Understanding with the City of Los Angeles Harbor Department for training coordination services, effective for a three-year period after Board of Supervisors approval and execution and approval by City of Los Angeles' Board of Harbor Commissioners.

 

 

 

SUMMARY:

 

Authorization of the Sheriff-Coroner to execute the Memorandum of Understanding with the City of Los Angeles Harbor Department will allow the Sheriff-Coroner Department to establish the roles and responsibilities in planning and co-presenting training to law enforcement staff at the Regional Maritime Law Enforcement Training Center located at the Port of Los Angeles.

 

 

BACKGROUND INFORMATION:

 

The City of Los Angeles Harbor Department (City) schedules boating safety courses each year.  As the Sheriff-Coroner Department (Sheriff) Marine Operations Bureau (Harbor Patrol) has the same responsibility to provide this training to its staff, the City partners with Sheriff’s Harbor Patrol to develop training strategies for the protection of the state’s waterways and ports, provide access to a law enforcement training facility and provide law enforcement training opportunities for federal, state, local, rural, tribal, territorial and other law enforcement agencies, which includes the provision of instructors at its Regional Maritime Law Enforcement Training Center (RMLETC).  The RMLETC is the regional training facility designated by the State of California's Department of Boating and Waterways.   

Additionally, the City identified that it required additional instructors who are skilled in both boat operations and law enforcement from Sheriff’s Harbor Patrol.  Sheriff and the Department of Boating and Waterways signed an agreement in September 2015, pursuant to Section 4.5-102(3) in the County's Contract Policy Manual, for the provision of boating safety instructors by Sheriff's Harbor Patrol.  The Board of Supervisors (Board) approved a similar Memorandum of Understanding (MOU) on December 15, 2015.  The City did not present the Board-approved MOU to its City of Los Angeles' Board of Harbor Commissioners for undisclosed reasons.  On October 25, 2016, a revised MOU was approved by the Board for a three-year period, effective upon Board approval and the execution of all necessary signatures.

Under the MOU, the City requests instructors from Sheriff on an as-needed basis.  The City is responsible for the operation and maintenance of the RMLETC, the creation and setting of class schedules, provision and maintenance of the vessels used, provision of the fuel for all of the vessels used and the provision of the classroom facilities, training materials and equipment. 

Courses include, but are not limited to, the Basic Maritime Officers' Course, Advanced Maritime Officers' Course, Anti-Terrorism Boat Operator's Course, Electronic Navigation, Maritime Incident Response, Basic First Responder Course, Maritime Smuggling Indicators Course, Boating Under the Influence Course, Boating Accident Investigation Course and Accident Reconstruction Course.  The duration of these courses each range from 40 to 80 hours of instruction.  Sheriff’s Harbor Patrol law enforcement staff requires the same training.  Sheriff utilizes an existing administrative Deputy Sheriff II to provide the training instruction, which is conducted during normal business hours.  No additional staffing is required.

Sheriff now requests Board authorization for the Sheriff-Coroner or authorized designee to approve a new three year Memorandum of Understanding with the City of Los Angeles Harbor Department (Attachment A), as noted in the Recommended Action.

 

The proposed MOU includes a mutual indemnification provision and no insurance requirements.  CEO/Risk Management has reviewed and approved the non-standard terms as both public entities are both highly self-insured.  A Risk Assessment or Modification of Insurance Terms Form is attached (Attachment B).
