RECOMMENDED ACTION(S):

 

 

1.

Find that the proposed action is Categorically Exempt from CEQA, Class 1 (Existing Facilities) and Class 6 (Information Collection), pursuant to CEQA Guidelines, Section 15301 and Section 15306.

 

2.

Authorize the Director of OC Public Works or designee to execute a contract with Geosyntec Consultants, Inc. for Landfill Regulatory Support Services in an amount not-to-exceed $3,250,000 for a five-year contract term commencing upon Board of Supervisors approval.

 

 

 

 

SUMMARY:

 

 

Approval of the contract with Geosyntec Consultants, Inc. for Landfill Regulatory Support Services will support continued landfill operations to remain in compliance with federal and state regulatory requirements for OC Waste & Recycling.

 

 

 

BACKGROUND INFORMATION:

 

OC Waste & Recycling is responsible for managing the County of Orange (County) solid waste disposal system. The system consists of three active regional landfill operations, 20 closed solid waste disposal sites and four household hazardous waste collection centers.

 

Approval of contract MA-299-20010542 (Contract) with Geosyntec Consultants, Inc. (Consultant) (Attachment A) to provide specialized Landfill Regulatory Compliance Support Services (Services) is recommended to maintain compliance with South Coast Air Quality Management District, Regional Water Quality Control Boards, California State Water Resources Control Board, Local Enforcement Agency, CalRecycle and Environmental Protection Agency regulations.

 

The Consultant will provide specialized services that are primarily focused on achieving agency-wide compliance with environmental regulations related to air quality, water quality and public health and safety. The Services will include, but not be limited to, the following: regulatory permitting and reporting; groundwater and surface water quality testing, monitoring and staff training; landfill flares source testing; aerial photogrammetry and other miscellaneous engineering support services. Failure to comply with these regulations may result in violations of landfill operating permits and/or fines.

 

OC Public Works issued a Request for Proposal (RFP) for Services to nine Architect-Engineer firms on the Countywide Qualified Vendor List. The RFP was advertised from August 5, 2019, through August 29, 2019, on the County online bidding system. A total of two proposals were received in response to the RFP.

 

On September 16, 2019, the evaluation panel completed the written evaluation process and provided its final recommendation. The evaluation panel consisted of five subject matter experts: three from OC Waste & Recycling, one from OC Public Works and one outside representative.

 

OC Public Works has conducted due diligence on the Consultant. Reference checks were satisfactory and completed with the County of San Bernardino, the County of San Diego and the City of Los Angeles, Bureau of Sanitation regarding similar projects. The Memorandum of Recommendation (Attachment C) and Summary of Evaluators Scoring (Attachment D) are attached.

 

OC Public Works is requesting Board of Supervisors (Board) approval of a Contract with the Consultant, in an amount not-to-exceed $3.25 million. Services to be provided by the Consultant are of a specialty nature and beyond the current workload capacity of OC Waste & Recycling in-house staff.

 

The Contract includes subcontractors. See Attachment B for information regarding subcontractors and Contract Summary Form.

  

Compliance with CEQA: The proposed action is Categorically Exempt (Class 1) from the provisions of CEQA pursuant to Section 15301 of the CEQA Guidelines, since Class 1 (Existing Facilities) consists of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographic features, involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. In addition, the proposed action is also Categorically Exempt (Class 6) from the provisions of CEQA pursuant to Section 15306 of the CEQA Guidelines, since Class 6 (Information Collection) involves basic data collection, research, experimental management and resource evaluation activities that do not result in a serious or major disturbance to an environmental resource. This Contract will allow for regulatory support services, which may include maintenance of existing landfill environmental control system infrastructure, which is consistent with a Class 1 and Class 6 Categorical Exemption determination.

 

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this Contract are included in the FY 2019-20 Budget for Fund 299: OC Waste & Recycling, 100 percent and will be included in the budgeting process for future years.

 

The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
