RECOMMENDED ACTION(S):

Find that Final Mitigated Negative Declaration (MND) No. IP 12-079, previously approved by the Board on January 29, 2013, reflects the independent judgment of the County of Orange and is adequate to satisfy the requirements of CEQA for the Coyote Creek Bikeway Use Agreement project based on the following additional findings: |

The circumstances of the project are substantially the same and MND No. IP 12-079, adequately addressed the effects of the proposed project. No substantial changes have been made in the project, no substantial changes in the circumstances under which the project is being undertaken and no new information of substantial importance to the project which was not known or could not have been known when the previous MND No. IP 12-079, was approved had become known and no further environmental review is required. |

SUMMARY:
Approval of Use Agreement D13-094 with Los Angeles Flood Control District will support the Fourth Supervisorial District Bikeways Strategy, which seeks to increase recreational opportunities for Orange County residents.
BACKGROUND INFORMATION:
The Fourth Supervisorial District Bikeways Collaborative was initiated to identify, prioritize, and implement regional bikeway improvements within the Fourth Supervisorial District. The Collaborative includes the Orange County Transportation Authority, the County, Caltrans and the cities of Anaheim, Buena Park, Fullerton, La Habra, and Placentia. The Coyote Creek Class I (off-road, paved) Bikeway was identified as one of ten regional bikeway corridors that would help to improve bikeway connectivity in this area of the County. The Coyote Creek Bikeway is a proposed regional, master-planned, mountains-to-sea bikeway that follows the edge of Los Angeles and Orange counties from the Pacific Ocean to a point 12 miles inland. The entire proposed Coyote Creek Bikeway corridor spans a total of 9.6 miles along Coyote Creek Channel.
The proposed project will extend the completed bikeway that follows the east arm of Coyote Creek along the border of Los Angeles and Orange counties between the cities of Cerritos and La Habra to the city of Buena Park. When completed, the ultimate bikeway will connect to the existing bikeway along the west arm of Coyote Creek that currently links to the San Gabriel River bikeway and the Pacific Ocean in the City of Seal Beach.
On January 29, 2013, the Board approved MNP IP 12-079 and approved the proposed Coyote Creek Bikeway improvements to provide the documentation required by Federal and State regulatory agencies for permit approvals.
The proposed bikeway extends into Los Angeles County Flood Control District (LACFCD) fee right of way which has been maintained by mutual agreement by Orange County Flood Control District since 1956 (Agreement 566-U). To construct and open the bikeway for public access, LACFCD requires a Use Agreement for the proposed improvements and operation. OC Parks staff has reviewed and approved the agreement language.
OC Public Works will return to the Board in the future for approval of final plans and special provisions and authorization to advertise for bids. The MND has been approved by the Board and the 100 percent design plans are on file with the Clerk of the Board.
Compliance with CEQA: This project is a necessarily included element of the project considered in MND No. IP 12-079, approved by the Board on January 29, 2013, for the Coyote Creek Bikeway Improvements Project which adequately addressed the effects of the proposed project. No substantial changes have been made in the project, no substantial changes in the circumstances under which the project is being undertaken and no new information or substantial importance to the project which was not known or could not have been known when the MND IP 12-079 was approved, has become known therefore no further environmental review is required.
