RECOMMENDED ACTION(S):

 

Authorize the Director of OC Public Works or designee to execute a contract with Mark Thomas & Company, Inc. for Architectural-Engineering and Design Services for the Brea Boulevard/Brea Canyon Road Widening Project, in an amount not-to-exceed $3,129,503 for a contract term of three years with the option to renew for two additional one year terms upon Board of Supervisors approval.

 

 

 

 

SUMMARY:

 

Approval of the contract with Mark Thomas & Company, Inc. for Architectural-Engineering and Design Services for the Brea Boulevard/Brea Canyon Road Widening Project will support the implementation of maintenance and repair projects in a timely manner and will help continue the safe and efficient operation of Brea Boulevard and Brea Canyon Road.

 

 

 

BACKGROUND INFORMATION:

 

The Brea Boulevard/Brea Canyon Road Widening Project (Project) is approximately 9,500 feet or 1.81 miles in length (project limits) and is located within both the City of Brea (City) and the unincorporated area of the County of Orange (County).  OC Public Works has identified the need to widen a significant portion of the Project from Canyondale Drive to the County/County of Los Angeles boundary line, approximately 3,200 feet northeast of Tonner Canyon Road due to the currently increasing and future forecasted traffic congestion during peak hours within that area.  Brea Boulevard/Brea Canyon Road is a 30-feet wide, two-lane undivided roadway (one through lane in each direction) with portions of the roadway having unpaved, earthen shoulders, no curb and gutter and with other developed portions of the roadway with existing curb and gutter and sidewalks.  The existing roadway right-of-way widths vary from approximately 60-feet to 100-feet.  Within the Project limits of the roadway, the posted speed limit is 55 miles per hour (mph) in the portion within unincorporated area of the County and 45 mph in the portion within the City.  In addition, there are three existing bridge crossings over Brea Creek that were constructed circa 1929 and 1930 that are in need of replacement.

 

OC Public Works proposes to deliver the Project in three phases using alternate project delivery methods: Phase 1 will be the intersection of Brea Boulevard and Tonner Canyon Road, which will be delivered via Design Bid Build (DBB); Phase 2 includes the replacement of the three bridges and is planned to be delivered via Construction Manager at Risk; Phase 3 includes all remaining roadway work and will be delivered via DBB.

 

OC Public Works issued a Request for Proposal (RFP) for Architectural-Engineering and Design Services (Services) for the Project. The RFP was advertised from June 18, 2018, through July 9, 2018, on Bidsync, the County online bidding system. A total of four submittals were received in response to the RFP.

 

On July 19, 2018, the RFP Evaluation Panel (Panel) completed the written evaluation process and recommended interviewing all four consultant firms (Firms).  On July 26, 2018, interviews were conducted with the Firms and the Panel provided its final recommendation to award a contract to Mark Thomas & Company, Inc. (A-E).  OC Public Works then negotiated for Services for the Project with the A-E in an amount not-to-exceed $3,129,503. The A-E has been evaluated and is qualified to perform Services for the Project based on reference checks completed with the City of Fullerton and the Santa Barbara County Association of Governments.  OC Public Works is requesting Board of Supervisors (Board) approval of Contract MA-080-19010130 with the A-E in an amount not-to-exceed $3,129,503, per year, for three years, commencing upon Board approval, with the option to renew for two additional years.

 

The Memorandum of Recommendation (Attachment C) and Summary of Evaluators Scoring (Attachment D) are attached.

 

The Contract includes subcontractors. See Attachment B for information regarding subcontractors and Contract Summary Form.

 

Compliance with CEQA:  This action is not a Project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to CEQA since it does not have the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not commit the County to a definite course of action in regard to a Project since it involves the approval of a contract to provide Services for the Project. This proposed activity is therefore not subject to CEQA. Any future action connected to this approval that constitutes a Project will be reviewed for compliance with CEQA.

 

This contract is to obtain Services for the Project. The proposed Project and environmental impact report would be subject to a future Board action.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this Contract are included in the FY 2018-19 Budget and will be included in the budgeting process for future years. The funding sources for this Project include Orange County Transportation Authority (OCTA) M2 Funds via Arterial Capacity Enhancement Program in the amount of $2,308,500, the City Contribution Local Match of $57,500 via OCTA M2 funds and the County portion via OC Road Fund 115, $763,503. This Project is included in the OC Public Works Capital Improvement Program. 

 

The proposed Contract includes a provision stating the Contract is subject to and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of this Contract. If such appropriations are not approved, this Contract may be immediately terminated without penalty to the County.
