RECOMMENDED ACTION(S):

 

Authorize the County Procurement Officer or authorized Deputy to execute Amendment Number One to the sole source contract with Intoximeters Inc. for Alcosensor Instruments parts and accessories, for the period of October 17, 2019 through October 16, 2020, in an amount not to exceed $104,991, for a revised cumulative contract total amount not to exceed $314,973, renewable for two additional one-year periods.

 

 

 

SUMMARY:

 

Approval of Amendment Number One to the sole source contract with Intoximeters Inc. for Alcosensor Instruments parts and accessories will allow the Sheriff-Coroner Department to continue to support its Portable Evidential Breath Alcohol Testing Program to assist in maintaining safe driving and boating environments.

 

 

BACKGROUND INFORMATION:

 

The Sheriff-Coroner Department (Sheriff) employs a Portable Evidential Breath Testing program to test potential alcohol-impaired drivers.  California regulations require that the Forensic Alcohol Laboratory be responsible for the breath instrumentation used within its jurisdiction.  The items supplied by Intoximeters, Inc. are needed for use with the instruments for the Portable Evidential Breath Testing program.  These instruments are manufactured by Intoximeters, Inc. to individual customer's specifications; Intoximeters, Inc. is the sole proprietor of these specific instruments and software.  The proposed contract is a sole source contract, and a completed Sole Source Request Form is attached to this Agenda Staff Report (Attachment C).

 

On October 17, 2017, the Board of Supervisors (Board) approved a sole source contract with Intoximeters, Inc., for the two-year period of October 22, 2017 through October 21, 2019, in the not to exceed amount of $209,982.  However, the contract’s “Term of Contract” stated that the contract would be effective “ . . . upon execution of all necessary signatures and continue for two calendar years . . .”  The last signature was executed on October 17, 2017.  Therefore, the contract’s effective date is technically October 17, 2017.  Since no costs were billed for the period of October 17, 2017 through October 21, 2017, Sheriff is not requesting a re-approval of the original contract.  The contract term for proposed Amendment Number One is for the period of October 17, 2019 through October 16, 2020 to ensure there is no lapse in services. 

 

Contractor performance has been confirmed as at least satisfactory.  Sheriff has verified that there are no concerns that must be addressed with respect to contractor's ownership/name, litigation status or conflicts with County interests. 

 

Sheriff now requests Board approval for the County Procurement Officer or authorized Deputy to execute Amendment Number One to the sole source contract with Intoximeters Inc. for Alcosensor Instruments parts and accessories, for the period of October 17, 2019 through October 16, 2020, in an amount not to exceed $104,991, for a revised cumulative contract total amount not to exceed $314,973, renewable for two additional one-year periods.  This contract is submitted for Board approval less than 30 days prior to the start of the contract, as the vendor did not return the signed contract in time to file for previous Board meetings.  This contract does not currently include subcontractors or pass through to other providers.  See Attachment D for the Contract Summary Form.

 

 

FINANCIAL IMPACT:

 

Appropriations for this contract are included in the Sheriff-Coroner's FY 2019-20 Budget for Budget Control 060, and will be included in the budgeting process in future years.  The contract contains language allowing the Sheriff-Coroner Department to terminate the contract without penalty with cause or after 30 days of written notice without cause in the event that funding is reduced and/or not available to continue funding the contract.
