RECOMMENDED ACTION(S):

 

 

1.

Find that the project is categorically exempt from CEQA, Class 1, (Existing Facilities) pursuant to CEQA Guidelines, Section 15301.

 

2.

Authorize the Board of Supervisors to execute the Cooperative Agreement with the Orange County Conservation Corps, for a five-year term in the amount of $500,000 per year in a total not-to-exceed amount of $2,500,000, effective October 28, 2019, though October 27, 2024.

 

 

 

 

SUMMARY:

 

Approval of the Cooperative Agreement with the Orange County Conservation Corps will provide work crews to support OC Public Works in performing maintenance activities for County of Orange infrastructure and the Orange County Flood Control District as well as for contract cities and transportation agencies.

 

 

 

BACKGROUND INFORMATION:

 

The Orange County Conservation Corps (OCCC) is a non-profit organization and is also a subsidiary of, and certified by, the California Conservation Corps as a Local Community Conservation Corps per California Public Resources Code 14507.5. The OCCC serves young adults who need support in the transition from adolescence to adult employability by providing work projects that benefit the community while instilling a work ethic and a sense of public service. In many cases, OCCC provides the first paid work experience for Orange County's young adults. Sometimes called the "Second Chance at Success," the OCCC is, for some, a last chance to avoid gangs, stay free of drug abuse, avert incarceration and ultimately ensure a positive life as working, productive members of the community.

 

OC Public Works, as a sponsor, proposes to partner with OCCC to provide youth members training in job skills by assigning work projects related to public service conservation work for the maintenance of road and flood facilities and environmental education while working at sites being established for mitigation. The OCCC will provide the County of Orange and the Orange County Flood Control District with work crews to support in-house personnel by performing general labor type maintenance activities such as the removal of invasive weeds and overgrown vegetation; removal of debris and clearing of flood control channels; erosion control; storm clean-up; and preparation of sand bags (Activities).

 

OC Public Works explored other staffing and private contracting options and found the agreement with OCCC to be a cost-effective method of performing the aforementioned unskilled labor. Costs associated with the agreement include supervision, local transportation of crews, emergency response and overtime as needed. Therefore, OC Public Works is requesting the Board of Supervisors (Board) approve the Cooperative Agreement (Agreement) with OCCC, in an amount not-to-exceed $500,000 per year for a five-year period, for a cumulative total of $2.5 million, effective October 28, 2019, through October 27, 2024.

 

OC Public Works has successfully contracted with the OCCC under previous agreements for similar type of maintenance activities. The Board-approved agreements with OCCC on October 28, 2014, August 25, 2009, September 11, 2007, and August 24, 2004.

 

The current Agreement with the OCCC is for an amount not to exceed $300,000 for each year of the Agreement. OC Public Works is requesting that the not-to-exceed amount be increased to $500,000 per year in the new agreement since OCCC is the primary supplier for OC Public Works for labor resources that perform various Activities within all flood control channels and facilities. The increased amount will help to ensure that OC Public Works has the necessary resources to maintain facilities and to prepare for, and respond to, storm events. The OCCC’s schedule availability and dedication to OC Public Works projects provides for a stable labor resource that promotes consistent scheduling and execution of Activities.

 

Section H of the proposed agreement provides for mutual indemnification and deviates from the County's standard indemnification provision. CEO Risk Management and County Counsel reviewed the terms of the Agreement and determined them to be acceptable.

 

Compliance with CEQA: The proposed project is categorically exempt (Class 1) from the provisions of CEQA pursuant to Section 15301, because it involves an Agreement for performing general labor type of maintenance activities on existing public facilities with no expansion of use.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this Agreement are included in the FY 2019-20 Budget for Fund 115: OC Road at 30 percent, and Fund 400: OC Flood at 70 percent and will be included in the budgeting process for future years.

 

This Agreement shall remain in effect for five years unless terminated upon 60 days written notice from either party to the other.
