RECOMMENDED ACTION(S):

 

 

1.

Find that the Old County Courthouse Phase III Maintenance Project is categorically exempt from the provisions of CEQA, Classes 1 (Existing Facilities) and 31 (Historical Resource Restoration/Rehabilitation), pursuant to Sections 15301 and 15331 respectively, because it consists maintenance and repairs to an existing historical building involving no expansion and the rehabilitation, restoration and reconstruction will be done in a manner consistent with the Secretary of Interior's standards.

 

2.

Award construction contract to K.C. Restoration Co., Inc. for the Old County Courthouse Phase III Maintenance Project in the amount of $1,255,193.

 

3.

Authorize the Director of OC Public Works or designee to execute the construction contract with K.C. Restoration Co., Inc., after the required bonds and certificates of insurance have been submitted and approved by the County Executive Office/Office of Risk Management and County Counsel.

 

4.

Authorize return of bid guarantees to all bidders, upon execution of the Contract.

 

 

 

 

 

 

 

SUMMARY:

 

Award of the construction contract to K.C. Restoration Co., Inc. for the Old County Courthouse Phase III Maintenance Project will provide the repair and restoration of the stone and windows on the north, east and west facades of the historic Courthouse.

 

 

 

BACKGROUND INFORMATION:

 

In January 2013, OC Community Resources/OC Parks negotiated a contract with Thirtieth Street Architects, Inc. to develop and execute a maintenance plan for the Old County Courthouse (Courthouse) at 211 W. Santa Ana Boulevard to restore, repair and maintain certain historic building materials elements. The plan was divided into four phases. Phase I of the maintenance plan consisted of plan development, historian review and materials testing and was completed in October 2014. Phase II of the maintenance plan consisted of the repair and preservation of the stone and windows on the south façade and was completed in 2017. The current Old County Courthouse Phase III Maintenance Project (Project) portion of the maintenance plan consists of repair and restoration of the stone and windows on the north, east and west facades of the Courthouse.

 

In 2018, OC Public Works negotiated a contract with Page and Turnbull Inc. to develop plans for the Project. The plans provide for the design and construction of preservation and repair measures for sandstone and granite masonry, cast-in-place concrete cornice, cement stucco gable, entry stairs and porches and wood-framed windows at the north, east and west facades of the building. This Project is necessary to preserve the historic value and character of the property.

 

On June 4, 2019, the Board of Supervisors (Board) approved plans, specifications and bid documents, made CEQA findings and set the bid opening date for the Project that was advertised through the Invitation for Bids (IFB) process.

 

On June 4, 2019, OC Public Works issued contractor Pre-Qualification documents through the County of Orange (County) online bidding system, in an effort to select the most experienced, responsible and responsive contractors. Five contractors responded and were pre-qualified and approved to continue to the next step.

 

On June 19, 2019, OC Public Works issued an IFB to the five pre-qualified contractors for the Project.

 

The following summarizes the four bids received on July 10, 2019, and provides a comparison against the Engineer’s Estimate (EE):

A full summary of the four bids received can be found in the Bid Summary as Attachment C.

 

The initial lowest bidder was New Creation Engineering & Builders, Inc., however the County determined their bid was non-responsive based on the bidder not performing at least 25 percent of the base bid amount (BBA) within its own organization as required in the Instructions to Bidders Section of the bid packet. New Creation Engineering & Builders, Inc., would be performing 11 percent of the BBA and their subcontractor would be performing 89 percent of the BBA. It was then determined that K.C. Restoration Co., Inc. (Contractor) had submitted the lowest responsive and responsible bid.

 

The lowest responsive and responsible bid submitted by the Contractor for this Project is approximately 12.3 percent below the EE of $1.4 million. The deviation of 12.3 percent between the apparent low bidder and the EE is due to the competitive bidding environment. The bids covered a reasonable variance range with the highest bid approximately $40,000 thousand over the EE and the lowest, disqualified bid approximately $315,000 thousand lower than EE.

 

The Contractor's License Number was verified as current and active through the Contractors State License Board database on July 12, 2019. A copy of the verification is on file.

 

OC Public Works has conducted due diligence on the Contractor. Reference checks were satisfactory and completed with the City of Long Beach, the City of South Pasadena and AIMCO/Housing & Urban Development regarding similar projects. OC Public Works is recommending the Board approve MA-012-20010162 (Contract) in a total not-to-exceed amount of $1,255,193 for a term effective upon execution by the Director of OC Public Works or designee.

 

This Contract includes subcontractors. See Attachment B for information regarding subcontractors and Contract Summary Form.

 

OC Public Works is procuring construction services following the bid process outlined in Public Contract Code Section 22032 for this Project and in accordance with Section 4.5 of the 2019 Design and Construction Policy Manual.

FINANCIAL IMPACT:

 

Appropriations for this Contract are included in the FY 2019-20 Budget for Fund 406, OC Parks and will be included in the budgeting process for future years.

 

The proposed contract includes a provision stating the contract is subject to, and contingent upon, applicable budgetary appropriations approved by the Board for each fiscal year during the term of this contract. If such appropriations are not approved, this contract may be immediately terminated without penalty to the County.
