SUMMARY:
Executing Agreement CT-080-12010124 with Daniel B. Stephens and Associates, Inc. to conduct a groundwater and surface water study in the Newport Bay Watershed will support water quality enhancement and regulatory compliance.
BACKGROUND INFORMATION:
On December 10, 2009, the Santa Ana Regional Water Quality Control Board issued a Time Schedule Order (TSO) R8-20009-0069 to regulate groundwater-related discharges, particularly those containing elevated selenium levels, in the Newport Bay Watershed (Watershed). The TSO mandates the County of Orange, Orange County Flood Control District, and other entities that are subject to the TSO to develop and implement a Best Management Practices Strategic Plan (Plan) describing a phased approach for complying with the TSO requirements. In order to develop an effective plan, it is critical to understand the movement between groundwater and surface waters, and in particular how selenium is transferred from one to the other.
The purpose of the proposed study is to identify and quantify the sources of water (including precipitation, irrigation application, and deep aquifer up-welling) that influence discharges of selenium-laden groundwater into creeks and channels in the Watershed. The analysis will provide information on the forces that drive groundwater movement and whether or not it is feasible to develop a predictive model of groundwater movement for the Watershed. The work product will assist the entities in the development of targeted measures to alleviate selenium problems in the Watershed and provide important information on whether efforts to curb surface applications of water will reduce groundwater discharges or if treatment of groundwater and surface water is the only viable path to controlling selenium. Once these measures are identified costs can be ascertained. If a predictive model is feasible, developing such a model will be considered in the future separate from this study.
On June 21, 2011, your Board approved the selection of Daniel B. Stephens & Associates, Inc., as the primary Architect-Engineer (A-E) firm to conduct a groundwater and surface water study in the Watershed and authorized the County Purchasing Agent or his authorized Deputy to negotiate an Agreement. The Agreement for A-E Services will not exceed $129,991.
Compliance with CEQA: The subject agreement is Categorically Exempt (Class 6) from the provisions of CEQA pursuant to Section 15306 of the CEQA Guidelines.
FINANCIAL IMPACT:
Costs for this study are shared among the Newport Bay Watershed partners through Agreement D99-128: Watershed Cities: 61.81 percent; Irvine Ranch Water District: 12.15 percent; Irvine Company: 12.15 percent; OC Flood Control District: 7.29 percent; OC Watersheds: 3.84 percent; and Lennar Homes of California: 2.76 percent. Contributions from these partners provide revenue to the OC Watersheds Fund for 96.16 percent of this expense, or $124,999. The County's 3.84 percent share of the cost, $4,992, is budget in the OC Watersheds Fund.
