RECOMMENDED ACTION(S):

 

 

1.

Find the subject Project to be Categorically Exempt from the provisions of CEQA pursuant to Section 15301, Class 1 (Existing Facility), of the CEQA Guidelines.

 

2.

Award Contract to Highland Construction, Inc. for the Black Star Canyon Road Bridges Project in the amount of $704,081.

 

3.

Authorize the Chairman of the Board to execute the Contract when the required bonds and insurance certificates have been submitted and approved by County Executive Office Risk Management and County Counsel.

 

4.

Authorize return of bid security to all bidders after contract execution.

 

 

 

 

SUMMARY:

 

Award of Contract to Highland Construction, Inc. in the amount of $704,081 for the Black Star Canyon Road Bridges Project will support improving access for emergency services and the public to the unincorporated County wilderness areas and the Cleveland National Forest.

 

 

 

BACKGROUND INFORMATION:

 

Black Star Canyon Road (BSCR) was built in the 1920’s utilizing U.S. Department of Agriculture funds and provides public access to the Cleveland National Forest (CNF). Beginning at Silverado Canyon Road, BSCR traverses approximately 6 miles and then becomes Skyline Drive at the Orange/Riverside County line with a narrow 12 to 14 foot wide substandard dirt road. The County has various express easements over the road and other public rights of access under the doctrine of common law dedication due to the public’s continuous and unimpeded use of the road since the early 20th Century.

 

The road was originally planned as a major thoroughfare and once appeared on the Master Plan of Arterial Highways.  Up until 1987, the road was in the County maintained road system. On May 27, 1987, your Board terminated maintenance of the road and restricted vehicular access.  The road is currently a public road used for pedestrian and recreational purposes as well as for fire and emergency services access.

 

In February 2006, use of the road by firefighting equipment triggered a road failure requiring the construction of a concrete inter-locking block wall to mitigate slope erosion and restore access for fire suppression activities.  On August 22, 2006, your Board approved an emergency declaration due to a slope failure and OC Public Works subsequently completed repairs with the termination of the emergency on October 31, 2006. On August 5, 2008, your Board approved an emergency declaration to repair multiple slope failures along the roadway and OC Public Works subsequently completed the repairs with the emergency terminated on September 9, 2008. 

 

On April 5, 2011, your Board authorized the use of tax increment funds from the Neighborhood Development and Preservation Project (NDAPP) to fund programs and activities related to public improvements, which include Inter-Canyon Bridge Improvements.  The Orange County Fire Authority (OCFA) secured a consultant to evaluate structural integrity of the bridges. The inspection report was completed in January 2009, noting that the bridges were originally designed for ten ton weight limit loads about half the capacity required for firefighting earthmoving equipment and fire trucks.

 

The Project work consists of removing the three existing deteriorated timber deck bridges along Black Star Canyon Road and replacing with precast concrete voided slab bridges and construction of three 24 inch Cast-In-Drilled-Hole Piling behind the existing abutments. Pile footings will be used in lieu of spread footings to greatly reduce the excavation and environmental disturbance limits. The existing abutments will remain in place to minimize disturbance to the creek and assist in bank scour protection. New precast concrete voided slabs will replace the old decks. The precast option further minimizes disturbance of the creek, which reduces regulatory requirements and mitigation costs. New equestrian-height bridge railings will be weathering steel, which compliment the rural character of the area for aesthetic purposes. The new bridges will accommodate firefighting vehicles and D9 dozers as well as riding and hiking trail users.

 

On June 28, 2011, your Board approved the Plans and Special Provisions; made CEQA findings; and set the bid opening date for the Black Star Canyon Road Bridges Project. The following summarizes the eight bids received on July 27, 2011:

The low bid submitted by Highland Construction, Inc. for this Project is less than one percent ($3,571.00) above the Engineer's Estimate.  The Contractor’s License No. 743775 was verified as current and active through the Contractors State License Board database on July 27, 2011, a copy of the verification is on file. Highland Construction, Inc. has submitted acceptable references and OC Public Works recommends award of the contract.

 

Compliance with CEQA: On June 28, 2011, your Board found the subject project to be Categorically Exempt (Class I) from the provisions of CEQA pursuant to Section 15301 (maintenance of existing facilities) of the CEQA Guidelines.
