RECOMMENDED ACTION(S):

 

 

1.

Find that the Caspers Wilderness Park Old Corral & San Juan Meadows Shade Structures Project is categorically exempt from CEQA Class 1 (Existing Facilities) pursuant CEQA Guidelines Section 15301 and Class 2 (Replacement or Reconstruction) pursuant CEQA Guidelines Section 15302.

 

2.

Award construction contract to Pub Construction, Inc. for the Caspers Wilderness Park Old Corral & San Juan Meadows Shade Structures Project in the amount of $367,311, effective July 27, 2021, to be completed within 180 calendar days of the effective date of the Notice to Proceed.

 

3.

Authorize the Director of OC Public Works or designee to execute the construction contract with Pub Construction, Inc.

 

4.

Authorize return of bid guarantees to all bidders upon execution of the contract.

 

 

 

 

SUMMARY:

 

Award of the construction contract to Pub Construction, Inc. for the Caspers Wilderness Park Old Corral & San Juan Meadows Shade Structures Project will enhance the park visitor experience by replacing two aging shade structures and building two new shade structures.

 

 

BACKGROUND INFORMATION:

 

Ronald W. Caspers Wilderness Park (Caspers) is an 8,000-acre protected wilderness preserve nestled among the river terraces and sandstone canyons of the western coastal Santa Ana Mountains. Coastal Live Oak, California Sycamore trees, seasonal wildflower displays, various native wildlife and running streams add to this wilderness park’s rich beauty. In addition to hiking, bike and equestrian trails, Caspers features an Interpretive Center, public amphitheater and camping and picnic facilities.

 

Caspers features several campgrounds for individual, equestrian or group camping, including the San Juan Meadows Group Area (San Juan) for overnight camping and the Old Corral Picnic Area (Old Corral) for day-use. OC Community Resources/OC Parks schedules capital maintenance projects based on an Asset Condition Assessment (ACA), which identifies both the existing condition and the lifespan of assets across the County of Orange (County) parks system to determine project priority. Two existing shade structures at San Juan, built in 1981, were identified in the ACA to be in need of replacement due to structural deterioration from decades of wear and tear and damage caused by woodpeckers. Old Corral does not currently have any shade structures and has seen a reduction of native trees resulting from extended years of drought. Adding new shade structures at Old Corral would greatly enhance park visitor experience by providing more protection from the sun and adequate shade from extreme heat. Both San Juan and Old Corral are popular facilities in Caspers that are used regularly by visitors, particularly with the increase in visitation of outdoor spaces experienced across the County wilderness park system in the last year, as well the expanding Rancho Mission Viejo residential communities near the park entrance.

 

On November 20, 2019, OC Public Works negotiated a contract with DKY Architects, dba Streshinsky Architectural Corporation, to develop plans and specifications for the Caspers Wilderness Park Old Corral & San Juan Meadows Shade Structures Project (Project). The design provides for the demolition and replacement of San Juan’s two existing wooden shade structures, as well construction of two new shade structures at Old Corral. The new structures will consist of a steel frame, metal deck, metal shingles, with support columns in a river-rock stone veneer. The steel structures will reduce wildland fire risk, deterioration from insects and cavity-nesting birds as well as maintenance needs and costs. The design also provides Americans with Disability Act (ADA) compliant parking spaces and constructing a new concrete pad for an ADA compliant portable restroom with accessible walkways. 

 

On April 13, 2021, OC Public Works issued Pre-Qualification documents through the County online bidding system. Seven contractors submitted Statements of Qualifications and were pre-qualified to continue to the next step. On April 27, 2021, OC Public Works issued an Invitation for Bid to the seven pre-qualified contractors for the Project. On May 11, 2021, OC Public Works received four bids; one bid was deemed non-responsive.

 

The following summarizes the three responsive bids and provides a comparison against the Engineer’s Estimate (EE):

The lowest responsive and responsible bid submitted by Pub Construction, Inc. (Contractor) for this Project is approximately 7.6 percent above the EE of $341,437. The Project has special requirements for metals fabrication and/or repair with fluctuating costs due to changes in material, delivery and labor costs caused by the current market conditions resulting from the COVID-19 pandemic.

 

OC Public Works is procuring services for this Project in accordance with the 2020 Design and Construction Procurement Policy Manual, Section 4.4-102. The County Preference Policy is not applicable to this contract award. A full summary of the three responsive bids received can be found in the Bid Summary as Attachment B.

 

OC Public Works is recommending the Board of Supervisors (Board) approve Contract CT-012-21011563 (Contract) with the Contractor, in an amount of $367,311, effective July 27, 2021, to be completed within 180 working days of the effective date of the Notice to Proceed.

 

The Contractor's license number was verified as current and active through the Contractors State License Board database on May 11, 2021. A copy of the verification is on file.

 

OC Public Works has conducted due diligence on the Contractor. Reference checks were satisfactory and completed with San Bernardino County, the City of Anaheim and Tae Woong, Inc. regarding similar projects.

 

This Contract includes subcontractors. See Attachment C for information regarding subcontractors and Contract Summary Form.

 

This Contract is being presented for Board consideration less than 30 days before the effective date due to additional Contract negotiations with the Contractor after the bid opening date of May 11, 2021.

 

Compliance with CEQA: The proposed Project is Categorically Exempt (Class 1 and 2) from the provisions of CEQA pursuant to Section 15301 and Section 15302, because it involves a maintenance and repair of existing public facilities involving no expansion of existing use (Class 1) and replacement and reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced (Class 2).

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this Contract are included in the FY 2021-22 Budget for OC Parks, Fund 406.

 

The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of the Contract. If such appropriations are not approved, the Contract may be immediately terminated without penalty to the County.
