RECOMMENDED ACTION(S):
Authorize the Purchasing Agent, or authorized Deputy, to issue and execute Amendment Four to Agreement MA-026-11012745 with Southern California Private Investigators, Inc. to renew the contract for Year Five commencing on August 1, 2015 through July 31, 2016 in the amount of $125,000 for a cumulative total contract amount not to exceed $575,000 for real estate document analysis services.
SUMMARY:
Approval of Amendment Four to Agreement MA-026-11012745 with Southern California Private Investigators, Inc. to renew the contract for the final fifth year term will allow the continued assistance to the Orange County District Attorney with the collection, organization, and analysis of complex records relating to real estate transactions from individuals, financial institutions, and public records sources in order to preliminarily prepare cases for investigation by Orange County District Attorney investigators.
BACKGROUND INFORMATION:
The OCDA’s Real Estate Fraud Unit investigates and prosecutes real estate fraud crimes in Orange County and provides a central location for victims to report real estate fraud through a link on the OCDA website for victims to report suspected real estate fraud. The Unit also works cooperatively with the California Department of Real Estate, the California Attorney General's Office, the California State Bar, and the California Franchise Tax Board as well as regional federal/state mortgage fraud task forces on a variety of investigations of real estate cases.
On July 19, 2011, the Board approved Agreement MA-026-11012745 with Southern California Private Investigators, Inc. in the amount not to exceed $100,000 for a one-year period commencing on August 1, 2011 through July 31, 2012, renewable for four additional one-year periods at the same amount to assist OCDA with the collection, organization, and analysis of complex records relating to real estate transactions from individuals, financial institutions, and public records sources in order to preliminarily prepare cases for investigation by OCDA investigators.
Amendments 1 and 2 were approved administratively by the Purchasing Agent pursuant to the Contract Policy Manual section 3.3-111. These amendments were issued to renew the Agreement for Year Two and Year Three.
On June 17, 2014, the Board authorized execution of Amendment 3 to increase the contract monetary limit by $30,000 for a revised annual contract total not to exceed $125,000 for fiscal year 2013-14 and renew the contract for Year Four in the amount of $125,000 for fiscal year 2014-15.
The contract is due for renewal for the final fifth year term. The contractor has been performing the service as required by the contract terms and conditions. This contract does not include subcontractors or pass through to other providers. See Attachment D for contract summary. The District Attorney requests Board approval to issue and execute Amendment 4 to renew the contract for Year Five in the amount of $125,000 as referenced in the Recommended Action. This Amendment is being presented to the Board in less than 30 days prior to the commencement of the Agreement due to year-end workload, preventing the filing for Board approval on an earlier Board date. If required, contract start date may be modified. The District Attorney will issue a Request For Proposal (RFP) to solicit bids for this service for fiscal year 2016-17.
FINANCIAL IMPACT:
By Resolution No. 09-020, your Honorable Board adopted a fee not to exceed $3.00 for the recording of certain real estate instruments by the County Clerk-Recorder and approved the establishment of the Orange County District Attorney (OCDA) Real Estate Fraud Prosecution Fund effective April 13, 2009 to fund the investigation and prosecution of real estate fraud crimes pursuant to California Government Code Section 27388. Appropriations for this Agreement are included in the Agency's FY 15-16 Adopted Budget for Fund 12G and will be included in the budgeting process for future years.
