RECOMMENDED ACTION(S):
Adopt by resolution the attached updated County of Orange Equal Employment Opportunity (EEO) and Anti-Harassment Policy and Procedure.
SUMMARY:
Approving the updated Equal Employment Opportunity and Anti-Harassment Policy and Procedure will ensure compliance with the California Fair Employment & Housing Act.
BACKGROUND INFORMATION:
In 1999, the Board of Supervisors adopted the initial Countywide Equal Employment Opportunity (EEO) policy and procedure guidelines to ensure compliance with all applicable laws and regulations pertaining to equal employment opportunity, prevention of workplace discrimination, harassment and retaliation. Since the adoption of the original 1999 EEO policy and procedure document, Human Resource Services (HRS) periodically reviews and recommends updates to ensure the County’s compliance with current State and Federal laws and to clarify and strengthen the policy where appropriate. The last such change was a comprehensive update approved by the Board of Supervisors on June 18, 2013 (Item # 80). Prior to June 18, 2013, an update occurred on October 13, 2012 (Item # 15).
On September 9, 2014, Governor Jerry Brown approved AB 1443 and AB 2053. AB 1443 extends the protections of the Fair Employment and Housing Act (FEHA) to unpaid interns and volunteers. AB 2053 mandates that employers covered under AB 1825 (legislation mandating sexual harassment training) add prevention of abusive conduct (bullying) training into their current workplace harassment training program. Both AB 1443 & AB 2053 took effect on January 1, 2015. The updated EEO policy reflects these amendments to the FEHA and expands the scope of persons protected under the EEO policy (currently employees and applicants only) to include unpaid interns and volunteers, as well as add ‘abusive conduct’ as a prohibited behavior.
