The term of the lease will be effective on July 1, 2011, and end on June 30, 2012, with the option to extend the lease for five (5) additional successive renewal terms of one (1) year. |
SUMMARY:
The County Executive Office recommends approval of the attached Lease Agreement to lease office space located at 1275 N. Berkeley Avenue, Fullerton, CA 92832 to house staff.
BACKGROUND INFORMATION:
The County of Orange is the owner of the real property in the, City of Fullerton, and the building, commonly referred to as the North Justice Center with a street address of 1275 North Berkeley Avenue, Fullerton, CA 92832-1258.
The County Executive Office recommends that the Board of Supervisors authorize the County to enter into a lease agreement with the Judicial Council of California, Administrative Office of the Courts for the benefit of the Superior Court of California, County of Orange, for use of approximately 1,494 square feet of space held by the County as exclusive use space under the Court transfer agreements on the third floor of the North Justice Center for use by the Court and the general public primarily for a Self-Help Center or any other legal use which is reasonably comparable. This space is not currently needed for County operations at the Courthouse, so the lease accommodates a use needed by the Court while retaining County control of the space in case of future need.
This Lease will be effective on July 1, 2011, and end on June 30, 2012, with the option to extend the lease for five (5) additional successive optional renewal terms of one (1) year. The lease amount, due on the first day of each month, will be Three Thousand Four Hundred Thirty-Six Dollars ($3,436). Because the lease will not actually begin on the effective date, the County and AOC have agreed that rent will be prorated from the actual date of occupation of the space on July 20, 2011, as provided in section 9 of the Lease.
The Lockyer-Isenberg Trial Court Funding Act of 1997 (AB 233) transferred the obligation for funding of trial court operations from counties to the State. In 2002, Trial Court Facilities Act (SB 1732), required the transfer of court facilities from the counties to the State, with the State’s interests to be represented by the Judicial Council of California. The County worked diligently with the Administrative Office of the Courts to transfer the trial court facilities within the County. Eleven individual building-by-building transfer agreements were approved by your Board during 2009, along with joint occupancy agreements in the shared use court facilities. North Justice Center facility transfer was approved by the Board on November 10, 2009, and all facility maintenance responsibilities were transferred to the Administrative Office of the Courts in 2010.
The North Justice Center consists of two connected buildings with a total of 18 courtrooms in 131,843 usable square feet. The Court exclusive area is 89,544 (90.31%) square feet. The County exclusive area is 9,608 (9.69%) square feet. The Common area is 32,691 square feet.
The Lease Agreement being presented to the Board will allow the County to lease 1,494 square feet of the County exclusive area space to the Administrative Office of the Courts. This Lease Agreement will not make any changes in the terms of the transfer documents approved by the Board on November 10, 2009. The County remains responsible for maintenance of the County exclusive area of 9,608 square feet at North Justice Center.
