RECOMMENDED ACTION(S):

SUMMARY:
Accepting the Chromebooks, Data-Enabled Hotspots and wireless broadband subscriptions will help bridge the digital divide in our communities.
BACKGROUND INFORMATION:
The California State Library and the Southern California Library Cooperative (SCLC) are partnering together to bring an opportunity to obtain Chromebooks and Data-Enabled Hotspots (Items) valued at $65,000 to OC Public Libraries.
Coronavirus Aid, Relief, and Economic Security Act funds were provided to the Institute of Museum and Library Services through the federal Library Services and Technology Act, which requires libraries to comply with the Children's Internet Protection Act (CIPA) to receive devices. Funding for the initiative is to address the digital divide during COVID-19. The California State Library granted SCLC $1.6 million dollars to provide Items to CIPA-compliant libraries in California.
The SCLC will purchase 20 Chromebooks with CIPA-compliant filtering and 252 hotspots, with data subscriptions for 12 months, for OC Public Libraries to help bridge the community's digital divide. These additional Chromebooks and WiFi hotspots will provide more avenues for patrons to access broadband from their homes. All OC Public Libraries branches will receive hotspots, with the OCPL Mobile Library receiving all 20 Chromebooks and 150 WiFi hotspots to bring to the neighborhoods, parks, senior centers and community centers they visit. Each OCPL branch will receive an additional one to four hotspots, to add to their current inventory, with higher allocations for lower-income areas and larger branches. As a regional Library system, the hotspots can also be requested and transferrable to accommodate demand.
The equipment will be purchased by SCLC and shipped directly to OC Public Libraries' headquarters for processing and distribution to branches. The data for the hotspots will be provided through Mobile Citizen, LLC and County of Orange. Mobile Citizen, LLC is a data plan provider who is working with SCLC to provide California libraries with data plans for hotspots under this initiative. OC Public Libraries is requesting authorization for the County Procurement Officer or authorized Deputy to execute the proposed Mobile Citizen, LLC's Direct Customer Terms of Service Contract (TOS Contract) and authorization to execute a letter authorizing SCLC to pay Mobile Citizen, LLC for OC Public Libraries’ hotspots and data plan subscriptions (Authorization Letter) in a form substantially similar to the letter attached as Attachment A. Upon the execution of the Authorization Letter, SCLC will directly pay the costs of the TOS Contract. The TOS Contract contains non-standard contract terms that have been reviewed and approved by County Executive Office/Risk Management, as reflected in the Risk Assessment form attached as Attachment C. Following the conclusion of the TOS Contract, ownership and use of equipment will transfer to County of Orange, OC Public Libraries.
