RECOMMENDED ACTION(S):

 

 

1.

Find that the recommended action is not a project as defined by CEQA pursuant to Section 15378(b)(5) of the CEQA Guidelines.

 

2.

Adopt the attached Resolution amending the Bylaws of the Sunset Beach Local Coastal Program Advisory Committee.

 

 

 

 

 

SUMMARY:

 

Adopting the Resolution to amend the Bylaws of the Sunset Beach Local Coastal Program Advisory Committee (LCP Board) will support implementation of process enhancements for continuing the LCP Board’s responsibility for conducting public meetings to review proposed land development projects including, but not limited to, general plan amendments, specific plan/LCP amendments, Coastal Development Permits, subdivision maps, use permits, site development permits, variance permits, and signage as well as advising the County regarding any findings and recommendations in regard to implementing the public works component of the Specific Plan.

 

 

 

BACKGROUND INFORMATION:

 

On March 9, 1982, your Board adopted Resolution No. 82-349 authorizing the preparation of a Specific Plan (SP) for the Sunset Beach community as the appropriate mechanism for preparing the land use regulations necessary to implement the State mandated Local Coastal Program (LCP)/Land Use Plan for Sunset Beach and established the Sunset Beach LCP Board.

 

LCPs are basic planning tools used by local governments to guide development in the coastal zone, in partnership with the California Coastal Commission.  Following adoption by a City Council or County Board of Supervisors, an LCP is submitted to the Coastal Commission to review for consistency with State Coastal Act requirements.  After an LCP has been approved and certified by the Coastal Commission, permitting authority over most new development is transferred to the local government, which applies the requirements of the LCP in reviewing proposed new developments.

 

The Sunset Beach Specific Plan/Local Coastal Program (Sunset Beach SP/LCP) was adopted by Ordinance No. 3376 on March 30, 1983 by the Orange County Board of Supervisors pursuant to State Planning and Zoning Law, replacing all pre-existing zoning regulations in the Sunset Beach Community. Subsequent to the LCP’s adoption in 1983, your Board designated the Sunset Beach LCP Advisory Committee (commonly known as the "LCP Board") as the official citizen’s review group in Sunset Beach.  The LCP Board helped identify the community's identity and special needs of Sunset Beach and provides continuing community participation in the long-term process of implementing the provisions of this LCP.   The LCP Board provides a centralized forum for obtaining community opinion on land use and zoning issues and for transmitting recommendations to the County.

 

The Sunset Beach SP/LCP was subsequently amended by your Board by Ordinance No. 3407 on August 31, 1983 and by Ordinance No. 3798 on September 26, 1990. Also, on September 26, 1990, by Resolution No. 90-1244, your Board approved the Sunset Beach LCP Board Bylaws as the governing regulation for the authority and responsibilities of the official review body for that unincorporated area of the County subject to the Sunset Beach SP/LCP.

 

The proposed amendment of the Sunset Beach LCP Board Bylaws will clarify the terms of appointments for members as well as other revisions that will improve the accountability of the Committee to the Board of Supervisors. Attachment B is the redline version of the Bylaws identifying the proposed text changes. In summary, changes have been made to Article I Name, Purpose, Responsibilities, Definitions; Article II Membership; Article III Officers; Article IV Duties of Officers; Article V Meetings; Article VI Procedures; and Article VIII Authority. These revisions will clarify terms of office; the process for the appointment and termination of members; duties of the Officers; procedures for resignation; requirements for Officers; the scheduling/cancelling of meetings; procedures for conducting meetings; and confirming your Board's approval of the latest revision to the Resolution establishing the Sunset Beach LCP Advisory Board's authority.
