RECOMMENDED ACTION(S):

 

Acting as the Governing Body of the Orange County In-Home Supportive Services Public Authority, approve and adopt the attached 2016-2022 Memorandum of Understanding between the Orange County In-Home Supportive Services Public Authority and the United Domestic Workers of America/AFSCME Local 3930 for the period of July 1, 2016, to June 30, 2022.

 

 

 

 

SUMMARY:

 

The County Executive Office recommends approval and adoption of the 2016–2022 Memorandum of Understanding regarding terms and conditions of employment for the In-Home Supportive Services Provider Unit represented by the United Domestic Workers of America/AFSCME Local 3930.

 

 

 

BACKGROUND INFORMATION:

 

In-Home Supportive Services (IHSS) provides domestic services, personal care, protective supervision and paramedical services to individuals 65 years of age or older and to blind or disabled individuals of any age in their own homes. The purpose of the program is to allow eligible individuals to live safely at home rather than in costly and less desirable out-of-home facilities. The IHSS program is operated in accordance with the requirements of the Welfare and Institutions Codes as well as regulations and directives issued by the California Department of Social Services, the California Department of Health Services and the federal Center for Medicaid and Medicare Services.  There are approximately 27,457 IHSS recipients and 25,806 active Providers currently. While IHSS Providers are not County employees, the Board of Supervisors (Board) is the Governing Body of the Orange County IHSS Public Authority, which is the employer of record for collective bargaining purposes.

 

Following over a year of good faith negotiations, the parties reached a tentative agreement on May 14, 2019, regarding the proposed Memorandum of Understanding (MOU) under consideration by your honorable Board.  The membership of the United Domestic Workers of America has ratified the proposed agreement. 

 

A summary of the significant deal points in the successor MOU are as follows:

 

Term

 

Six-year term from July 1, 2016, through June 30, 2022.

 

Wages

 

Effective upon state approval following adoption of the MOU (estimated to be received in August 2019), IHSS Providers will be provided a wage supplement of 25 cents per hour above the base wage, which is the federal, state or other applicable minimum wage, whichever is greater.

 

Effective January 1, 2020, IHSS Providers will be provided an additional wage supplement of 25 cents per hour above the base wage for a total of 50 cents per hour above the base wage.

 

Supplies

 

Each fiscal year of the contract, the Orange County IHSS Public Authority will purchase supplies in an amount not to exceed $10,000, which would include, but not be limited to, medical supplies that will be distributed to IHSS Providers as needed.

 

Miscellaneous MOU Changes

 

Modifications to the union dues deduction language to comply with recent legislation and court decisions.

 

Modification to language outlining contingencies in the event wage and benefit funding at the federal or state level or the current cost sharing (Maintenance of Effort) formula changes protecting the County from incurring any additional cost.

 

Added language outlining that if federal or state funds become available for training at no cost to the County, the parties will meet to reach agreement on the amount of monies to be allocated and the trainings that will be offered.

 

 

FINANCIAL IMPACT:

 

The estimated total cost incurred over the term of the MOU through FY 2021-22 is $8,677,761 Net County Cost.  This total consists of $2,173,292 for FY 2019-20, $3,188,563 for FY 2020-21 and $3,315,906 for FY 2021-22. This is the County’s estimated increase to the In-Home Supportive Services Maintenance of Effort over the term of the MOU.
