RECOMMENDED ACTION(S):

 

 

1.

Approve the Memorandum of Understanding with the Anaheim Workforce Development Board to colocate the Social Services Agency at the Anaheim Workforce Connection for the period of July 1, 2019, through June 30, 2022.

 

2.

Authorize the Social Services Agency Director or designee to execute any necessary Memorandum of Understanding amendments that do not result in a cost to the County and that meet the requirements specified in the Workforce Innovation and Opportunity Act of 2014 Guidelines.

 

 

 

SUMMARY:

 

Approval of the Memorandum of Understanding between the Anaheim Workforce Development Board and the Social Services Agency will facilitate California Work Opportunity and Responsibility to Kids services at the Anaheim One-Stop Center.

 

 

BACKGROUND INFORMATION:

 

The Social Services Agency (SSA) is requesting the Board of Supervisors’ (Board) approval of the Memorandum of Understanding (MOU) with the Anaheim Workforce Development Board (AWDB) for the period of July 1, 2019, through June 30, 2022.  The AWDB is required to enter into a MOU with all mandated partners for the operation of their local America’s Job Center of California (AJCC), which was formerly called a One-Stop Career Center and is now called the Anaheim Workforce Connection (AWC).  The AWDB designs and coordinates workforce, economic and other community development activities and policies.  Pursuant to California Department of Social Services All County Letter 16-51, dated June 9, 2016, included as Attachment D, SSA is a mandated partner agency in the AJCC and collaborates with the AWDB and other AJCC partners in order to adopt policies that facilitate access for all customers, which includes low-skilled adults and youth. The purpose of the recommended MOU is to establish the respective roles and responsibilities of the AWDB and SSA concerning the operation of the AJCC, as it relates to shared services and customers, as well as to establish a framework to support the service delivery through the sharing of resources and costs.

 

The Workforce Innovation and Opportunity Act (WIOA) of 2014, Notice of Proposed Rule Making (NPRM) Section 678.305, included as Attachment D, requires that there be a comprehensive One-Stop career center in each local area. The enactment of WIOA provides new opportunities for the workforce system and California Work Opportunity and Responsibility to Kids (CalWORKs) programs to collaborate in meeting the needs of low-income individuals.  The CalWORKs program seeks to address poverty through an array of services designed to assist families in various stages of need.  CalWORKs provides temporary cash assistance to meet basic family needs and also provides employment, education and training programs to assist the families to move toward self-sufficiency through the Welfare-to-Work (WTW) program. 

 

Through collaboration and coordination with the AWDB and colocation of one CalWORKs/WTW Case Manager staff at the AJCC through a no cost license agreement, additional opportunities for CalWORKs families to find and obtain employment will be available. The colocated CalWORKs/WTW Case Manager staff will assist low-skilled adults and youth to obtain marketable skills and recognized credentials to help them enter and progress in the workforce. This is achieved by aligning, coordinating and integrating programs and services focused on connecting education, training and other services with in-demand occupations and the needs of employers.

 

On August 9, 2016, the Board approved the Phase I MOU between the City of Anaheim, the AWDB and SSA for the period of September 1, 2016, through June 30, 2019.  The Phase I MOU contained program content and specific guidelines for the implementation and administration of the AJCC. On October 17, 2017, the Board approved Phase II MOU between the AWDB and SSA for the period of November 1, 2017, through August 31, 2020.  The Phase II MOU defined how to best support the established service delivery model through the sharing of resources and costs. This proposed MOU shall supersede and cancel the existing Phase I and Phase II MOUs between the AWDB and SSA. Additionally, this proposed MOU shall combine the existing Phase I and Phase II MOUs to describe both implementation and administration, as well as resources and costs of SSA’s colocation at the AJCC. The proposed MOU is consistent with SSA’s MOU with the Santa Ana Workforce Development Board (SAWDB), which was approved by the Board on May 7, 2019, with the exception that there is no cost associated with utilizing the AWDB space, as SSA’s footprint at the AWDB is significantly smaller than at SAWDB.

 

As a result of new initiatives at the state level and the passing of WIOA, there are opportunities to streamline job seeker and employer services that will promote the building of career pathway programs and elevate service delivery to improve client outcomes.  Accordingly, an MOU with the AWDB combining the guidelines for the implementation and administration of the AJCC under the Phase I MOU and the framework for the sharing of resources and costs under the Phase II MOU will establish the framework for a unified service delivery system that best meets the needs of all shared customers served by AWDB and SSA.

 

The proposed MOU describes the services to be provided through the AJCC, SSA responsibilities, the referral process, data sharing, confidentiality, grievance procedures, term limits and other administrative and operational provisions that are consistent with the WIOA. 

 

Approval of this MOU will satisfy the requirements of WIOA (NPRM Section 678.500).  The MOU includes a non-standard Hold Harmless/Indemnification/Liability clause that has been approved by Risk Management.  A copy of the Risk Assessment or Modification of Insurance Terms form is included as Attachment E to this Agenda Staff Report.

 

Due to unanticipated delays with the finalization of terms, this MOU is submitted to the Board less than 30 days prior to the start of the Agreement.
