RECOMMENDED ACTION(S):

 

Authorize the County Procurement Officer or authorized Deputy to execute Amendment Number Two to renew the sole source contract with Pen-Link Ltd. for maintenance and support of Pen-Link Ltd. software, for the period of July 1, 2019 through June 30, 2020, and increase the contract by $846, in the annual amount of $44,345, for a revised cumulative contract total amount of $131,343, renewable for two additional one-year periods.

 

 

 

SUMMARY:

 

Approval of Amendment Number Two to the sole source contract with Pen-Link Ltd. will allow the Sheriff-Coroner Department to continue to contract for maintenance and support of Pen-Link Ltd. software used for intelligence purposes.

 

 

BACKGROUND INFORMATION:

 

The Regional Narcotics Suppression Program (RNSP) is a multi-agency task force administered by the Sheriff-Coroner Department (Sheriff).  RNSP works to target, investigate and prosecute subjects involved in large-scale narcotics trafficking and money laundering.  Seized illegal proceeds are returned to participating local agencies in the way of civil asset forfeiture.  The offices of RNSP have a Pen-Link software system installed in the wiretap room that provides for the collection, storage and analysis of telephone and internet communications for investigative purposes.

 

On November 14, 2017, the Board of Supervisors (Board) approved a new contract with Pen-Link Ltd., for the period of July 1, 2017 through June 30, 2018, in the annual not to exceed amount of $43,499.  Amendment Number One renewed the contract for the period of July 1, 2018 through June 30, 2019, in the annual not to exceed amount of $43,499.  Amendment Number One was approved administratively per the County Contract Policy Manual, Section 3.3-102.

 

Contractor performance has been confirmed as at least satisfactory.  The Department has verified that there are no concerns that must be addressed with respect to contractor's ownership/name, litigation status or conflicts with County interests.  

 

The current contract is required for software upgrades, maintenance and support of the system to keep it up-to-date and functioning at the optimum level.  Pen-Link Ltd. is the only vendor that can provide the annual mandatory maintenance, support and upgrades necessary for proper function and longevity of the system.  The proposed contract is a sole source contract and a completed Sole Source Request Form is attached to this Agenda Staff Report (Attachment C).

 

Sheriff now requests approval of Amendment Number Two to renew the sole source contract with Pen-Link Ltd., for the period of July 1, 2019 through June 30, 2020, and increase the contract by $846, in the annual amount of $44,345, for a revised cumulative contract total amount of $131,343.  The increase of $846 is due an increased cost of doing business.  Proposed Amendment Number Two also includes revised pricing for Years 4 and 5 of the contract:  $52,659 and $54,239, respectively.

 

This contract does not currently include subcontractors or pass through to other providers.  See Attachment D for the Contract Summary Form.  This contract is submitted for Board approval less than 30 days prior to the start of the contract, as the vendor did not return the signed contract in time to file for previous Board meetings.

 

 

FINANCIAL IMPACT:

 

Appropriations for the contract are included in the FY 2019-20 Budget, Fund 126, Regional Narcotics Suppression Program.  The contract contains language allowing the Sheriff-Coroner Department to terminate the contract without penalty with cause or after 30 days of written notice without cause in the event that funding is reduced and/or not available to continue funding the contract.
