RECOMMENDED ACTION(S):

 

Authorize the County Procurement Officer or authorized Deputy to execute Pepperdine University Contract for provision of youth diversion counseling services, for the term of July 1, 2021 through June 30, 2024, for an annual amount not to exceed $350,705, for a three-year contract amount not to exceed $1,052,115.

 

 

 

 

SUMMARY:

 

Approval of the Pepperdine University contract will allow the Sheriff-Coroner Department to contract for the provision of youth diversion counseling services to divert juveniles from criminal behavior and substance abuse by providing individual assessment and treatment.

 

 

 

 

 

BACKGROUND INFORMATION:

 

The state Crime Prevention Act of 2000 (AB 1913) provides funding for the ongoing operation of a youth counseling and diversion program established by the Sheriff-Coroner Department (Sheriff) to divert juveniles from criminal behavior and substance abuse by providing individual assessment and treatment.  Services are provided to juveniles referred by Sheriff, the Probation Department, parents and schools and to any juvenile desiring such services.  Services include intake assessments; individual, family, parent and group counseling; drug and alcohol classes; case management; and client advocacy.

 

These services have been provided by contract with Pepperdine University (Pepperdine) since 2001.  The following table details the recent contract history with Pepperdine for youth counseling and diversion program services.

Contractor performance has been confirmed as at least satisfactory.  Sheriff has verified that there are no concerns that must be addressed with respect to contractor's ownership/name, litigation status or conflicts with County interests.  Pepperdine has provided services to approximately 440 youth and their families during the contract term of July 1, 2020, through April 28, 2021, including nearly 2,500 hours of counseling services.   The Orange County Preference Policy is not applicable to this contract award. 

 

In 2020, during the midst of the RFP process, the County received guidance from the State of California regarding the containment of the COVID-19 virus to minimize the impact of the pandemic.  This guidance included restrictions that impeded the ability of Sheriff to complete the RFP process.  Sheriff had requested the Board to extend the Sixth Amendment of the Pepperdine University contract in order to accommodate the delay caused by COVID-19.  The RFP process has since been completed and Sheriff found that Pepperdine to be the most responsive bidder.  This contract will provide Youth Diversion Counseling Services to Juvenile clients.  These services have been provided via contracts for at least 10 years and no liability issues have occurred.  Participation by the parents and youth in the diversion services is voluntary and Sheriff believes the risk of liability is low even with the non-standard indemnification provisions, see Attachment E for the Indemnification and Limitation of Liability Form signed by County Counsel and County Executive Office Risk Management.

 

Thus, Sheriff now requests Board approval of the contract with Pepperdine for a three–year term, for the term of July 1, 2021, through June 30, 2024, for an annual amount of $350,705, for a total contract amount not to exceed $1,052,115.  This contract does not currently include subcontractors or pass through to other providers.  See Attachment C for the Contract Summary Form.  This contract is submitted for Board approval less than 30 days prior to the start of the contract due to the delays resulting from the COVID-19 pandemic situation.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this contract are included in the Sheriff-Coroner Department's FY 2021-22 Budget for Budget Control 060, and will be included in the budgeting process for future fiscal years.  This contract contains language allowing the Sheriff-Coroner Department to terminate the contract or reduce the level of services without penalty with cause or without cause in the event that funding is reduced and/or not available to continue funding the contract.
