RECOMMENDED ACTION(S):

 

 

1.

Approve the Third Amendment to the Five-Year Agreement for law enforcement services with the City of Villa Park for the term of July 1, 2021, through June 30, 2022.

 

2.

Approve the FY 2021-22 charges for law enforcement services to the City of Villa Park in an amount not to exceed $1,862,076, for a revised cumulative contract total amount not to exceed $6,838,199.

 

3.

Approve $177,041 as the total amount for special and supplemental services, including School Resource Officer, Directed Enforcement services, Special Events and Traffic Enforcement for the term of July 1, 2021, through June 30, 2022.

 

4.

Delegate to the Sheriff-Coroner or designee authority to execute written amendments to this law enforcement services agreement that increase or decrease the total FY 2021-22 cost of service by one percent or less of $1,862,076 and that do not materially change other provisions of the agreement.

 

5.

Delegate to the Sheriff-Coroner authority to execute an amendment to this agreement to substitute the City of Villa Park’s amended or new Traffic Violator Apprehension Program resolution, as long as the amendment does not materially change any other provision of this agreement.

 

 

 

 

SUMMARY:

 

Approval of the Third Amendment to the Five-Year Agreement with the City of Villa Park will allow the Sheriff-Coroner Department to continue to provide law enforcement services to maintain the safety and welfare of residents of Villa Park.

 

 

 

BACKGROUND INFORMATION:

 

The City of Villa Park has been contracting with the County of Orange (County) for the Sheriff-Coroner Department (Sheriff) to provide law enforcement services since 1962.  The table below notes when the Board of Supervisors (Board) approved the most recent agreements, amendments and any annual adjustment amount.

Sheriff requests Board approval of the Third Amendment to the Five-Year Law Enforcement Agreement for the term of July 1, 2021, through June 30, 2022, as noted in the Recommended Actions.  The total cost to the City of Villa Park for contracted law enforcement services for FY 2021-22 is $1,862,076.  In addition, pursuant to the Agreement, the City of Villa Park may request additional special and supplemental services, such as the use of a School Resource Officer, Direct Enforcement services, Special Event services and traffic enforcement, up to a maximum cost of $177,041, for a firm, fixed total cost of $2,039,117.  This total cost does not include any additional hours for the Motor Sergeant's required duties related to traffic enforcement. 

 

Agreement costs include salaries, wages, employee benefits, services and supplies, transportation expenses, as well as division, department and County (County-Wide Cost Allocation Plan) overhead.  FY 2021-22 cost is 7.07 percent higher ($123,099) than the current fiscal year final adjusted agreement of $1,738,977.  The net increase is due to updated salary and benefit changes approved by the Association of Orange County Deputy Sheriffs (AOCDS), Association of County Law Enforcement Managers (ACLEM), Orange County Managers Association (OCMA), the Orange County Employees Association (OCEA) and an increase in Sheriff overhead.  The AOCDS agreement was approved by the Board on October 8, 2019.  The Board approved the ACLEM, OCMA and OCEA agreements on October 22, 2019.

 

This Third Amendment to the Agreement is submitted for approval less than 30 days prior to the start of the proposed agreement due to an extended negotiation period over the terms and conditions in the Amendment, and the need to have the Villa Park City Council approval before presenting the Amendment to the Board for approval.  The Villa Park City Council approved this Amendment at its May 25, 2021, meeting.

 

 

 

FINANCIAL IMPACT:

 

The City of Villa Park is responsible for 100 percent of the costs related to this agreement.  Appropriations and Revenue for this agreement are included in Budget Control 060, Sheriff-Coroner FY 2021-22 Recommended Budget. Adjustment to reconcile positions with related appropriations and revenue to the adopted FY 2021-22 agreement will be requested in the FY 2021-22 Mid-Year Budget Report.
