RECOMMENDED ACTION(S):

 

 

Authorize the County Procurement Officer or authorized Deputy to execute Amendment Number Four to the Idemia Identity & Security USA LLC contract for live scan equipment, accessories, supplies, software and maintenance, for the term of August 22, 2021, through August 21, 2022, in an amount not to exceed $275,000, for a cumulative contract total of $1,938,240.

 

 

 

 

SUMMARY:

 

Approval of Amendment Number Four to the Idemia Identity & Security USA LLC contract will allow the Sheriff-Coroner Department to continue its contract for live scan equipment, accessories, supplies, software and maintenance.

 

 

 

BACKGROUND INFORMATION:

 

The Orange County Crime Laboratory (OC Crime Lab) is a Division of the Sheriff-Coroner Department (Sheriff).  The OC Crime Lab's Cal-ID Bureau maintains the County's local criminal fingerprint database and live scan fleet, serving all Orange County police agencies and residents.  Live scan systems electronically record and transmit fingerprint and palm print data from all criminal jail bookings.  These live scan devices are funded through revenue collected by the State of California Department of Motor Vehicles.  There are 52 TouchPrint Enterprise livescans located in 26 custody facilities and administrative areas of police departments, the Sheriff's Department, the District Attorney’s Office and the Probation Department.  Fingerprints and palm prints are captured for the following services:

Criminal bookings in custody facilities

Court-ordered bookings at the Sheriff's public counter

Court-ordered criminal registrations in both custody and public facing police and Sheriff's facilities

Applicant submissions as part of employment criminal records checks

 

Regular maintenance is required to avoid costly and time-consuming repairs, which could create delays in booking suspects into custody facilities in Orange County.  The existing contract with Idemia Identity & Security USA LLC provided for the purchase of live scan equipment, accessories, supplies, software and maintenance.

 

On August 22, 2017, the Board of Supervisors (Board) approved the MorphoTrust contract for the term of August 22, 2017, through August 21, 2020, in the not to exceed amount of $1,663,240, renewable for seven additional one-year terms.  The seven-year contract renewal term was requested as that encompasses the lifespan of the equipment.  Additionally, this contract included language to allow it to be amended as needed to reflect current standards.  When the parties have agreed that new standards should be used, the contract has been amended to identify the new standards.  Moreover, amendments that did not exceed 10 percent of the annual cost of the first year of the contract were able to be approved administratively.  Amendment Number One was approved administratively since the company had changed its name from MorphoTrust to Idemia Identity & Security USA LLC.  Amendment Number Two was approved administratively due to the exchange of one model of machine for another.  Amendment Number Three, which extended the time for the exchange of and upgrades to machines to be completed at no additional cost, was approved administratively on July 15, 2020, for the term of August 22, 2020, through August 21, 2021, by the Deputy Purchasing Agent based on the delegated authority granted by the Board as reflected in the Resolution of the Board Authorizing Emergency Contacting Authority dated March 26, 2020.

 

Sheriff now requests Board approval for Amendment Number Four to the Idemia Identity & Security USA LLC contract for the term of August 22, 2021, through August 21, 2022, in an amount not to exceed $275,000 for a total cumulative contract amount not to exceed $1,938,240.

 

This contract does not include subcontractors or pass through to other providers.  See Attachment C for Contract Summary.

 

 

 

FINANCIAL IMPACT:

 

Appropriations for this contract are included in the Sheriff-Coroner’s FY 2021-22 Budget for Fund 14E, Cal-ID System Costs, and will be included in the budgeting process in future years.  Funding for Fund 14E comes from revenue collected by the California Department of Motor Vehicles and can only be used for Cal-ID purposes.  This contract contains language allowing the Sheriff-Coroner Department to terminate the contract or reduce the level of services without penalty with cause or without cause in the event that funding is reduced and/or not available to continue funding the contract.
