SUMMARY:
Award of the construction contract to Aguilar & Calderon Corporation for the Ted Craig Regional Park Restroom No. 8 Replacement Project will enhance park visitor experience with added restroom capacity and provide stalls with greater accessibility in compliance with the current Americans with Disabilities Act standards.
BACKGROUND INFORMATION:
First opened in 1974, the Ted Craig Regional Park (TCRP), named after a long-time public servant, is a 124-acre County of Orange (County) park located in the City of Fullerton. The TCRP overlooks Fullerton Dam and offers large picnic areas, multiple playgrounds, sports fields and courts, a fishing lake and trails for biking and hiking. Restroom No. 8, which is an original amenity of TCRP, has deteriorated from wear and tear and needs replacement.
OC Public Works negotiated a contract with GA Design, Inc. to develop plans and specifications for the TCRP Restroom No. 8 Replacement Project (Project). The existing restroom is 714-feet, was constructed in 1974 and is not up to current Americans with Disabilities Act (ADA) standards. The facility features one side for women with three stalls and another side for men with two stalls and two urinals. This Project demolishes the old restroom and provides for a new 711-square-foot restroom building that will consist of eight unisex stalls, including four stalls in compliance with ADA. The Project entirely reconfigures the layout of Restroom No. 8 to enhanced privacy and provide more accommodations as well as a more pleasant experience for park visitors.
On February 17, 2021, OC Public Works issued contractor Pre-Qualification documents through the County online bidding system. Nine contractors responded and were pre-qualified and continued to the next step. On March 10, 2021, OC Public Works issued an Invitation for Bid to the nine pre-qualified contractors for the Project. OC Public Works received five bids; one was deemed nonresponsive. A full summary of the four responsive bids received can be found in the Bid Summary as Attachment B.

The Orange County Preference Policy is not applicable to this contract award.
The lowest responsive and responsible bid submitted by Aguilar & Calderon Corporation (Contractor) for this Project is approximately 14 percent below the EE of $599,738. OC Public Works has reviewed the EE and verified that the difference is not the result of errors or omissions in the estimate, but rather is attributed to the competitive environment.
OC Public Works is recommending the Board of Supervisors (Board) approve Contract CT-012-21011369 (Contract) with the Contractor in an amount of $515,291, effective June 22, 2021, to be completed within 365 calendar days of the effective date of the Notice to Proceed.
The Contractor's license number was verified as current and active through the Contractors State License Board database on March 3, 2021. A copy of the verification is on file.
OC Public Works has conducted due diligence on the Contractor. Reference checks were satisfactory and completed with the Los Angeles Department of Water & Power, City of Los Angeles and Los Angeles Cleantech Incubator regarding similar projects.
This Contract is being
presented for Board consideration less than 30 days before the effective date
due to additional Contract negotiations with the Contractor after the bid
opening date of March 31, 2021.
This Contract includes subcontractors. See Attachment C for information regarding subcontractors and Contract Summary Form.
OC Public Works is procuring these Services in accordance with the 2020 Design and Construction Procurement Policy Manual, Section 4.4-102.
Compliance with CEQA: The proposed Project is Categorically Exempt (Class 1, 2 and 3) from the provisions of CEQA pursuant to Section 15301, 15302 and 15303, because it provides for the exemption of minor alteration of existing structures involving negligible or no expansion (Class 1), replacement and reconstruction (Class 2) and new construction or conversion of small structures (Class 3).
FINANCIAL IMPACT:
Appropriations for this Contract are included in the FY 2021-22 Recommended Budget for OC Parks, Fund 406.
The proposed Contract includes a provision stating the Contract is subject to, and contingent upon, applicable budgetary appropriations being approved by the Board for each fiscal year during the term of the Contract. If such appropriations are not approved, the Contract may be immediately terminated without penalty to the County.
