RECOMMENDED ACTION(S):

 

 

1.

Approve Geographic Information System Digital Information Sharing Agreement between the County of Orange and Rancho Mission Viejo, LLC for a term effective June 22, 2021, through June 21, 2026.

 

2.

Authorize the Director of OC Public Works or designee to amend the Geographic Information System Digital Information Sharing Agreement, in substantially the same form, provided those amendments would result in minor, non-substantive changes.

 

 

 

 

SUMMARY:

 

Approval of the Geographic Information System Digital Information Sharing Agreement between the County of Orange and Rancho Mission Viejo, LLC will continue to support the Geographic Information System digital information sharing needs by each party relating to the Southern Subregion Habitat Conservation Plan and stewardship of natural lands in Orange County.

 

 

 

 

 

BACKGROUND INFORMATION:

 

On June 26, 2002, the County of Orange (County) and the U.S. Fish and Wildlife Service (USFWS) entered into Agreement No. 2505 for sharing of Geographic Information System Digital Information Files (GIS) for a period of five years with Rancho Mission Viejo, LLC (RMV). The agreement supported the needs for information by each party relating to the Natural Community Conservation Plan/Habitat Conservation Plan for the Southern Subregion of Orange County, such as associated habitats or geographic range. After the expiration of the Agreement No. 2505 in 2007, RMV and USFWS entered into a separate agreement for the sharing of GIS files.

 

The County and RMV have developed and created GIS with associated digital files to support the information needs of each party related to the Southern Subregion Habitat Conservation Plan (SSHCP), such as understanding the status of target species and habitat types, informing planning and management actions and coordinating data collection and management efforts. Data requests originating from the County may include updated GIS data of the SSHCP subareas; reserve boundary by use category and locations of invasive species targeted for removal under the SSHCP; status of Arundo removal activities undertaken as part of Southern Natural Community Conservation Plan/Master Streambed Alteration Agreement/Habitat Conservation Plan; and raw data requests that are associated with required regulatory reports such as the San Juan Creek Monitoring Report.

 

OC Public Works is recommending the Board of Supervisors (Board) approve GIS Agreement MA-080-21011551 (Agreement) with RMV effective June 22, 2021, through June 21, 2026, and authorize the Director of OC Public Works or designee to amend the Agreement, in substantially the same form, provided those amendments would result in minor, non-substantive changes.

 

OC Public Works is bringing this Agreement to the Board less than 30 days before commencement due to additional time required to complete negotiations.

 

Compliance with CEQA: This action is not a project within the meaning of CEQA Guidelines Section 15378 and is therefore not subject to CEQA, since it does not have the potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. The approval of this agenda item does not commit the County to a definite course of action in regard to a project since the action authorizes an Agreement for digital file sharing to support the needs by each party for information relating to the SSHCP and stewardship of natural lands in Orange County. This proposed activity is therefore not subject to CEQA. Any future action connected to this approval that constitutes a project will be reviewed for compliance with CEQA.

 

 

 

FINANCIAL IMPACT:

 

The County and RMV shall have the right to terminate this Agreement by giving the other party 10 calendar days written notice.
