RECOMMENDED ACTION(S):

 

Authorize the County Purchasing Agent or authorized Deputy to execute Master Agreement MA-042-15011816 with Pacific Bell Telephone Company dba AT&T DataComm, Inc. for the provision of network equipment maintenance, effective July 1, 2015 through June 30, 2016, in an amount not to exceed $204,144.

 

 

 

 

SUMMARY:

 

The Health Care Agency requests the Board to approve Master Agreement MA-042-15011816 with Pacific Bell Telephone Company dba AT&T DataComm, Inc. for network equipment maintenance.

 

 

 

BACKGROUND INFORMATION:

 

The Health Care Agency (HCA) utilizes vendors to provide network equipment maintenance and support services for upkeep of the HCA network infrastructure.  HCA is proposing to utilize Merced County's Fast Open Contracts Utilization Services (FOCUS) contract with Pacific Bell Telephone Company, dba AT&T DataComm, who is the selected vendor through their competitive bidding process to provide network equipment and maintenance support services.

 

The purpose of the FOCUS contract is to provide the means for counties, cities, schools, special districts, and other governmental entities in California and nationwide to purchase their needed telecommunications technology solutions through a formally bid contractual relationship. FOCUS also provides means for governments to reduce the costs of procurement while leveraging their dollars with other government entities to achieve greater buying power.

 

This Master Agreement is necessary to continue to provide support and maintenance to HCA network equipment until the CEO IT Managed Services Scope 2 related transformation event is completed. This transformation is underway and is expected to be completed by second quarter of 2016.  After the transformation is complete, the Scope 2 vendor (Xerox) will assume responsibility for support and maintenance.  Any decommissioned equipment during the course of the agreement period will be removed from support and maintenance. For any Cisco equipment, a request will be made to obtain a credit for the associated support and maintenance cost for the decommissioned equipment, to be applied towards the purchase of upgraded Cisco equipment and services. While there are no firm guarantees that such credits may be approved by Cisco, such requests for credits or refunds will be supported by the Cisco Service Manager, as indicated via a written assurance of such support provided by the Cisco Service Manager to the County.  There has been a decrease of $22,881 in this new Master Agreement as a result of transformed sites which are now on Xerox network equipment.

 

This Master Agreement contains an indemnification provision that does not include liabilities or claims that are the result of County’s willful misconduct.  CEO/Risk Management has reviewed the indemnification provision and has determined it to be acceptable for these services.

 

The Master Agreement does not have subcontracts.

 

The Health Care Agency requests that your Honorable Board authorize the County Purchasing Agent or authorized Deputy to execute Master Agreement MA-042-15011816 with Pacific Bell Telephone Company dba AT&T DataComm, Inc. as referenced in the Recommended Action.

 

 

 

FINANCIAL IMPACT:

 

This Master Agreement is included in the Health Care Agency’s FY 2015-2016 Recommended Budget.

 

The Master Agreement contains language which permits mutual reduction or termination without penalty if approved funding or appropriations are not forthcoming.
