SUMMARY:
Authorization to execute Contract MA-080-16011798 with Tapia Landscaping for Landscape Maintenance Services will support the provision of landscape maintenance at various County facilities.
BACKGROUND INFORMATION:
OC Public Works has been entrusted with the care of the grounds surrounding County buildings and parking structures, which include the Civic Center, Fruit Street Complex, County Operations Center and Data Center, Hutton Towers (Gates and Osborne Buildings) and associated Parking, Manchester Office Building/Juvenile Hall Plaza and associated Parking, the County Facility at Laguna Niguel (old South Court House), Berkeley Landscape (hill behind the North Court in Fullerton) and West Civic Center parking (Westminster). OC Public Works does not employ County staff to maintain the grounds at County office buildings and parking lots. Current contracts with J Orozco Enterprises, Inc., Tropical Plaza and Oakwest Landscape, Inc. will expire June 1, 2016.
On January 25, 2016, OC Public Works issued an Invitation for Bids (IFB) for Landscape Maintenance Services for Various County Facilities. The IFB was advertised on the County’s online bidding site and four responses were received. Based upon the criteria and evaluation procedures set forth in the IFB, contracts were awarded to three of the bidders as per the Bid Recap attached. Bidder J Orozco Landscape withdrew their bid citing that labor costs and other expenses would increase, so they could not accept a five year contract at this time. As a result, for those locations where J Orozco Landscape was the lowest bid, locations were awarded to the next lowest bidders. The contracts awarded to Quality Landscape Management and Tropical Plaza did not require Board of Supervisors (Board) approval because the annual value does not exceed $100,000 in accordance with Section 3.3-1.02 of the Contract Policy Manual.
OC Public Works is requesting authorization to execute Contract MA-080-16011798 (Contract) with Tapia Landscaping (Contractor) for Landscape Maintenance Services Various County Facilities, effective June 1, 2016, through June 30, 2021 in an amount not to exceed $600,420.
This Contract does not include subcontractors or pass through amounts to other providers. See Attachment C for Contract Summary Form.
OC Public Works has reviewed the Contractor’s references and qualifications and found that the Contractor is qualified. Reference checks were also completed with OC Community Resources regarding similar projects and were found satisfactory.
Compliance with CEQA: The proposed action is Categorically Exempt (Class 1) from CEQA pursuant to Section 15301 of the CEQA Guidelines, which provides exemption for maintenance of existing public facilities and structures. The action involves an agreement to support maintenance and repair of landscaping at various County facilities in the unincorporated areas of Orange County and its cities.
FINANCIAL IMPACT:
Appropriations and revenue for this Contract are included in the FY 2016-17 Recommended Budget and will be included in the budgeting process for future years. Appropriations for the contract are budgeted in OC Public Works, Budget Control 080 in which revenues from various departments are proposed to offset 44% of the cost.
The Contract contains language allowing for termination and contains language stating there is no guarantee given by the County or District regarding usage. The Contractor agrees to provide services as needed by the County.
