RECOMMENDED ACTION(S):

 

Authorize the County Purchasing Agent or authorized Deputy to renew Master Agreement MA-042-11011768 as MA-042-12011459 with The Regents of the University of California (UC), a Constitutional Corporation, on behalf of UC Irvine Pathology Services for the provision of phlebotomy and laboratory testing services, under the same terms, conditions, pricing, and scope of work commencing on July 1, 2012 through June 30, 2013, in an amount not to exceed $850,000.

 

 

 

 

SUMMARY:

 

In accordance with Board policy pertaining to service contract renewals, the Health Care Agency requests the Board to approve renewal of Master Agreement MA-042-11011768 with The Regents of the University of California, a Constitutional Corporation, on behalf of UC Irvine Pathology Services for phlebotomy and laboratory testing services.

 

 

 

BACKGROUND INFORMATION:

 

On July 21, 2009, your Honorable Board approved the Health Care Agency's (HCA) request to contract with The Regents of the University of California, a Constitutional Corporation, on behalf of UC Irvine Pathology Services (The Regents) for the provision of phlebotomy and laboratory testing services (Price Agreement N1000010857). This Agreement resulted from a competitive solicitation and your Board's approval included renewing the Agreement for FY 2011-12 which ends June 30, 2012.  The HCA is returning to request approval to renew Master Agreement, MA-042-10011768 (prior Price Agreement N1000010857) for July 1, 2012 through June 30, 2013, in an amount not to exceed $850,000 which is level funding with the current agreement.  The Regents has consistently provided satisfactory services. 

 

This Master Agreement supports services in several HCA service areas and will be supported by a variety of funding sources with the majority of funding coming from State realignment and the federal Ryan White Treatment and Modernization Act.

 

Public Health has a variety of programs utilizing laboratory services for screening and diagnostic testing of clients receiving medical services at public health clinics. The services provided by The Regents differ from those provided by the HCA's Public Health Laboratory which mainly tests for infectious diseases and organisms posing a public health threat.  The Regents provides general laboratory services that include routine types of tests similar to those requested through a medical office such as blood chemistries, cholesterol, metabolic panels, etc.  Correctional Health Services alsorequires laboratory testing services as part of medical evaluations and screening provided within the adult and juvenile correctional institutions.  

 

Behavioral Health Services (BHS) requires laboratory testing for clients prescribed certain since certain psychotropic medications that can have side effects, impacting a person's liver or other vital organ functioning.  Because BHS does not have staff qualified to draw blood, The Regents provide phlebotomy services in addition to laboratory services.

 

In this Master Agreement, the indemnification provisions vary from the County standard sole indemnification. The indemnification provision includes mutual indemnification clause. The indemnification clause also limits the Contractor’s liability to negligent or intentional acts of omissions including the actual alleged sexual misconduct of Contractor, its officers, employees or agents. CEO/Risk Management has previously reviewed the indemnification provisions and determined them to be acceptable for these services.

 

The Master Agreement contains language which permits reduction or termination without penalty if approved funding or appropriations are not forthcoming.

Laboratory Corporation of America (LabCorp)

Mayo Medical Laboratories

Quest Diagnostics, Inc.

Quest Diagnostics at Nichols Institute

Virologic, Inc.

Southern California Portable XRay and EKG

 

The Health Care Agency requests that your Board authorize the County Purchasing Agent or authorized Deputy to execute the renewal of Master Agreement MA-042-11011768 with The Regents of the University of California a Constitutional Corporation on behalf of UC Irvine Pathology Services as referenced in the Recommended Action.

This Master Agreement is included in the Health Care Agency's Fiscal Year 2012-13.
