RECOMMENDED ACTION(S):

 

 

1.

Approve the Agreement with The Regents of the University of California, a Constitutional Corporation, on behalf of UC Irvine School of Medicine, Department of Pediatrics for Provision of Child Abuse Medical Evaluation and Physician Services with a maximum obligation of $120,000 for the period July 1, 2012 through June 30, 2013.

Authorize the Health Care Agency Director or designee, on behalf of the Board of Supervisors, to execute the Agreement with the Regents of the University of California for Provision of Child Abuse Medical Evaluation and Physician Services.

 

 

 

 

SUMMARY:

 

The Health Care Agency requests approval of the Agreement for Provision of Child Abuse Medical Evaluation and Physician Services with The Regents of the University of California, a Constitutional Corporation, on behalf of UC Irvine School of Medicine, Department of Pediatrics.

 

 

 

 

BACKGROUND INFORMATION:

 

On May 17, 2011, your Honorable Board approved the sole source Agreement with The Regents of the University of California, a Constitutional Corporation, on behalf of UC Irvine School of Medicine, Department of Pediatrics (The Regents) for provision of Child Abuse Medical Evaluation and Physician Services with a maximum obligation of $120,000 for the period July 1, 2011 through June 30, 2012.  This Agreement is fully funded by Hoag Memorial Presbyterian Hospital and the Children and Families Commission of Orange County.  This is a sole source Agreement due to the need for specific clinical expertise and the university affiliation requirement in order to provide teaching and training of medical students and professionals.  The University of California, Irvine is affiliated with Children's Hospital of Orange County which is the primary center of pediatric care - including care needed as a result of abuse and neglect - in Orange County. 

 

Expert physician services are critical for identifying, evaluating, treating and preventing child abuse and neglect.  The proposed Agreement will continue to fund the provision of physician services for the Child Abuse Services Team (CAST).  CAST is a collaborative project involving the Orange County Social Services Agency, the Orange County District Attorney's Office and the Health Care Agency. The CAST goal is to reduce the trauma to children who are alleged victims of child abuse and neglect by providing forensic and support services in a centralized location. Services include forensic interviews, victim witness services, behavioral health therapy and forensic medical examinations.

 

The proposed Agreement, with a maximum obligation of $120,000 will allow child abuse physician services to be provided through June 30, 2013.  Since The Regents is the current service provider and the proposed Agreement will ensure continuity of services.  

 

Under the proposed Agreement, The Regents will provide physician services up to 20 hours per week and will include primary functions such as examinations of children who are alleged victims of abuse, consultation to the multi-disciplinary team investigating and prosecuting child abuse, and medical supervision of clinical staff at the CAST location.  Other services include court testimony for cases that are prosecuted, and education and training of medical residents.

 

The proposed Agreement contains mutual indemnification provisions, which vary from the County standard of sole indemnification.  CEO/Risk Management has approved the indemnification provision and determined the risk to be acceptable for these services.

 

The proposed Agreement does not have subcontracts.

 

The Health Care Agency requests that your Honorable Board approve the Agreement for Provision of Child Abuse Medical Evaluation and Physician Services with The Regents of the University of California, a Constitutional Corporation, on behalf of UC Irvine School of Medicine, Department of Pediatrics and authorized the Health Care Agency Director or designee to execute the Agreement as referenced in the Recommended Actions.

 

 

 

 

FINANCIAL IMPACT:

 

This Agreement is included in Health Care Agency's FY 2012-13 Requested Budget.

 

It is estimated that funding for these services represents ten percent or less of the contractor's total annual operating budget.  Should services need to be reduced or terminated due to a lack of funding, this Agreement contains language that allows Health Care Agency to give 60 days written notice to either terminate or renegotiate the level of services to be provided.  The notice will allow Health Care Agency staff adequate time to transition or terminate services to clients, if necessary.  Health Care Agency staff have reviewed this contractor's financial documentation, including its most recent financial statements.  At this time, there appear to be no issues that would impact the contractor's ability to perform the services.
