RECOMMENDED ACTION(S):

 

 

1.

Find that the proposed project is Categorically Exempt (Class 2, Section 15302) from the provisions of CEQA. 

 

2.

Approve Amendment No. 1 to the Agreement with California Building Evaluation and Construction, Inc. for the Terminal Generator Replacement project in the lump sum amount of $324,632.28, resulting in a new agreement amount of $1,183,632.28, and extend the Time of Completion of the Agreement by 749 calendar days, for a revised Time of Completion of 949 calendar days.

 

 

 

 

 

SUMMARY:

 

Approve and authorize execution of Amendment No. 1 to the Agreement with California Building Evaluation and Construction, Inc. in the lump sum amount of $324,632.28, resulting in a new Agreement amount of $1,183,632.28, and a revised Time of Completion of 949 calendar days.  Authorize the Chair to execute the Amendment; and make CEQA findings.

 

 

 

 

BACKGROUND INFORMATION:

 

On April 20, 2010, the Board awarded a contract to California Building Evaluation and Construction, Inc., for the Terminals A & B Emergency Generators Replacement project in the lump sum amount of $859,000.00, and with a Time of Completion of 200 calendar days.  The project was scheduled for completion on November 6, 2011.  The contract provides for the purchase and installation of two 625 KVA emergency diesel generators with skid-mounted fuel tanks to supply the essential electrical power needs of John Wayne Airport in the event of a primary power failure.  The contract plans specified locating the generators between the Airport’s lower public roadway and Parking Structures A2 and B2.  These plans and specifications were prepared by Toft Wolff Farrow Inc..  The project provides for the removal and disposal of the two existing emergency diesel generators located on the Terminal rooftop.

 

During the construction and installation of the Terminal C emergency generator (under a separate contract), JWA determined that locating the emergency generator on the airport apron was preferred over the location on the lower roadway, for the following reasons:  enhanced security and safety would be achieved by locating the emergency generator on the apron as it is inaccessible to the public; environmental benefits are achieved, as fueling operation would be performed with added safety and effectiveness on the apron compared to similar operation on the lower roadway; and the apron location would allow for more effective and efficient execution of routine maintenance of the emergency generator.

 

Determining that the same benefits achieved on Terminal C emergency generator could also be achieved on Terminal A & B emergency generators, JWA directed Toft Wolff Farrow to revise the plans and specifications, identifying the location of the emergency generators on the airport apron.  By locating the Terminal A & B emergency generators on the apron, JWA would realize the same benefits as achieved by locating the Terminal C emergency generator on the apron.  Placement of the Terminal A and B emergency generators on the apron will now be consistent with the current location of the new Terminal C emergency generator.

 

The cost increase of relocating the emergency generators onto the Airport apron is directly attributed to the increase of material (conduit, copper, mounting brackets) required to complete the work, as well as additional equipment and labor time needed to execute the work.  JWA access and security restriction have also contributed to the added cost of the change order.

 

The additional contract time required for relocating the emergency generators onto the Airport apron is directly attributed to the process of revising the plans and negotiating the price of the change order.  From the point at which JWA directed the contractor to stop work, it has taken 749 calendar days for the Airport to redesign the plans and specification, and to negotiate a fair and reasonable cost of the change order.  The work will still require 200 calendar days to execute as stated in the original contract, with a revised time of completion date on or about November 24, 2012.

 

AMENDMENT NO. 1

 

Amendment No. 1 will increase the Agreement by the lump sum amount of $324,632.28, and will provide for the placement of the emergency generators on the JWA apron adjacent  to Terminal A and B.  Bulletin #1 drawings and specifications have been prepared for this revised placement scope of work and are included as part of this change.   Amendment No. 1 will increase the Agreement Time of Completion for the Terminal Generator Replacement work by 749 calendar days, for a revised Time of Completion of 949 calendar days.

The proposed project is Categorically Exempt (Class 2, Section 15302) from the provisions of CEQA. 

 

 

 

FINANCIAL IMPACT:

 

There are sufficient funds in the Airport Construction Fund 281 to pay for Amendment No. 1.
