RECOMMENDED ACTION(S):
Approve Agreement Number CDB1015 with MedTox Laboratories, Inc. for the Provision of Drug Testing Services for the second and final option year in an amount not to exceed $616,521 for the period of July 1, 2015 through June 30, 2016 for a cumulative total of $3,082,605.
SUMMARY:
Approval of Agreement Number CDB1015 with MedTox Laboratories, Inc. to provide Drug Testing Services will enable the Social Services Agency to continue to provide court ordered drug testing services to demonstrate sobriety compliance for clients receiving family reunification services.
BACKGROUND INFORMATION:
On June 14, 2010, the California Department of Social Services (CDSS) approved SSA to release a Request for Proposals for a three-year contract with the option to renew for two additional one-year periods under the same terms and conditions without a competitive process. On April 19, 2011, your Board approved a three-year Agreement with MedTox Laboratories, Inc. for the Provision of Drug Testing Services for the period of July 1, 2011 through June 30, 2014, with an annual maximum obligation of $616,521, for a total of $1,849,563 for the entire three-year term. On April 29, 2014 SSA returned to your Board to request approval of a one-year agreement with MedTox Laboratories, Inc. for the period of July 1, 2014 through June 30, 2015, with the same annual maximum obligation of $616,521 and same terms and conditions.
SSA is returning to the Board for approval of the second and final one-year agreement with MedTox Laboratories Inc. for the period of July 1, 2015 through June 30, 2016, with the same maximum obligation of $616,521 and same terms and conditions.
The service supports families’ reunification and maintenance efforts as required by their case plans in accordance with California Welfare and Institutions Code Section 16501(a) subsection (1) and CDSS Division 31-315 regulations, both of which include substance abuse testing as a service-funded activity. In addition, services provided under the agreement align with the Good Health and Safe Homes and Communities indicators reported in the 20th Annual Report on the Conditions of Children in Orange County. For further information, see Attachments A and B.
Per the above regulations the Agency has the responsibility to provide reasonable services. Failure to do so puts the Agency at risk of losing federal funding under Code of Federal Regulations (CFR) Title 45, Subtitle B, Chapter XIII, Subchapter G, Part 1356, and Section 1356.21. For specific information see Attachment C.
MedTox has satisfactorily performed the following primary services:

Randomly selecting enrolled clients with various testing frequencies. |

2. |
Offering multiple urine collection sites, with extended hours, in and outside of Orange County and in other states. |

3. |
Analyzing urine specimens and posting test result data on a secured web-based program that is available 24 hours a day, seven days a week. |
To maximize clients’ opportunities to comply with court ordered testing, MedTox provides 10 urine collection facilities located in the following Orange County cities: two in Anaheim, Fountain Valley and Santa Ana and one in Huntington Beach, Irvine, Mission Viejo and Placentia.
Approximately 5.08% of clients served reside outside of Orange County. Typically, a client served outside of Orange County is a non-custodial parent or caregiver whose court ordered case plan requires drug testing. To serve this population, MedTox provides services at 21 facilities located throughout the contiguous counties. In addition, MedTox also provides services to SSA clients residing in other states, ranging from Hawaii to New Hampshire and multiple states in between.
MedTox's unit cost of service, $23.00 for testing in Orange County and $27.00 for testing outside of Orange County, is level with costs dating back to July 2008.
Outcomes
During the period of January 2014 through December 31, 2014 MedTox provided drug testing services for an average of 735 unduplicated clients each month, resulting in a total of 22,061 drug tests. In this time period, 1,088 clients had drug testing as part of their Court Ordered Case Plan. Test data shows that 11.01% tested positive for one or more substances. In the same calendar year 324 cases were reunified and of those 166 had Substance Abuse Testing as one of the case plan components.
FINANCIAL IMPACT:
Appropriations for this Agreement will be included in the FY 2015-16 Recommended Budget and will be included in the budgeting process for future years.
Federal and State dollars are comprised of Child Welfare Services (CWS) and 1991 and 2011 Realignment program funds. Wraparound reinvestment funds are comprised of 40% State and 60% County dollars and can only be reinvested in children’s programs.
Contingency of Funds
The contractor is aware that funding or portions of funding for this Agreement may be contingent upon the State budget receipt of funds from and/or obligations of funds by the State to the County and inclusion of sufficient funding for the services hereunder in the budget approved by the County's Board of Supervisors for each fiscal year covered by this Agreement. If such approval, funding or appropriations are not forthcoming or are otherwise limited, the Agreement in this agenda report contains language which permits the County to immediately terminate, reduce or modify the Agreement without penalty.
