SUMMARY:
Approval of the five-year lease with the State of California to allow the State to continue use of a portion of the County's Data Services Center for operations of its telecommunications equipment.
BACKGROUND INFORMATION:
The State of California (State) has leased computer room space in the County's Data Services Center since July 1, 1996 to support the State's Teal Data Center. Because of the success of this program the State has continued to occupy approximately 225 square feet of computer room space. The most recent five-year lease, which substantially raised the rental rate over the previous lease, expired effective December 31, 2011. The State continues to lease the space pursuant to the holdover provisions of the expired lease. The current rental rate is $2,975 per month on a full service gross basis. The State has evaluated its space needs and has requested to renew the lease for an additional five-year term.
Under the proposed new lease, the rental rate will remain at its current $2,975 per month ($13.22 per square foot). CEO/Information Technology has evaluated the State’s power usage over the last 15 years and determined that continuing the current rental rate for this use is equitable reimbursement for the County.
The proposed lease will provide a continued annual rental revenue stream of $35,700 for five additional years for space at the Orange County Data Center that is currently unused by the County of Orange. Either party may terminate the lease upon giving 365 days prior written notice. Additional terms of the lease are outlined in the attached Lease Summary.

Legal Requirements:
The use conforms to the General Plan of the City of Santa Ana, and the project is Categorically Exempt (Class 1) from the provisions of CEQA pursuant to Guidelines Section 15301. The project conforms with the Americans with Disabilities Act.
